Excerpts from Plan Commission Minutes of January 6,2011 continued: "Maximum Area per Sign: 50 square feet, properties containing five (5) acres or more may have a maximum area of 75 square feet." Amend SECTION XXV.E.2.c (Signage-Signs in Office District)to now read as follows: "Maximum height: Ten(10) feet, properties containing five (5) acres or more may have a maximum height of 15 feet." Amend SECTION XXV.F.2.a(Signage-Signs in Business and Industrial Districts)by replacing: "Lot"with"Frontage". Amend SECTION XXV.F.2.b (Signage-Signs in Business and Industrial Districts) to now read as follows: "Maximum Area per Sign: 75 square feet." Amend SECTION XXV.F.3.a (Signage-Signs in Business and Industrial Districts) to now read as follows: "Number per Frontage: One (1); however,properties that have 500 feet of linear frontage or more are permitted two (2) freestanding signs and properties with 800 feet of linear frontage or more are permitted three (3) freestanding signs." Amend SECTION XXV.F.3.b (Signage-Signs in Business and Industrial Districts) to now read as follows: "Maximum Area per Sign: i. Sign Advertising One or Two Businesses: 75 square feet or one (1) square foot per each linear foot of frontage,to a maximum of 100 square feet. ii. Multi-Tenant Sign Advertising Three or More Businesses: 75 square feet or one (1) square foot per each linear foot of frontage,to a maximum of 200 square feet." Staff recommends approval of the amendments as proposed. Section XXIX.G. of the Zoning Ordinance requires the Plan Commission to hold a public hearing and make recommendations to the City Council on amendments to the Zoning Ordinance. A motion to forward Calendar Number 10-38 to City Council with a recommendation of approval is suggested. Mr. Mickler asked for an explanation of the Zoning Board of Appeals Powers and Duties concerning the Electronic Message Unit Signs. Ms. Stickle said the Zoning Board of Appeals would be allowed to grant a variance to the petitioner. Presently, the electronic message unit signs have to be setback 100 feet from the property line of any residential district or use. If a petitioner requested a variance to reduce the setback, the surrounding properties would have an opportunity to be heard at the public hearing. If the variance is granted, the electronic message unit would only be allowed to operate between the hours of 6:00 a.m. and 11:00 p.m. There were no objectors present. It was moved and seconded (Livingston/Sadorus) to forward Cal. No. 10-38 to the City Council with recommendation for approval as presented by staff. Motion carried unanimously.
