Stickle, Senior Planner <br /> SUBJECT: Amend R-3 RDP in the 2300/2400 Block of Florian Avenue <br /> SUMMARY RECOMMENDATION: Staff recommends approval to amend the R-3 RDP Single <br /> Family Residence District Residence Development Plan. <br /> The City Plan Commission voted 6-0 to recommend approval of this petition at the January 6, 2011 <br /> meeting;the minutes of the meeting are attached. <br /> BACKGROUND: In November 1967,the City Council approved a rezoning petition to rezone properties <br /> in Home Park Manor from R-1 and R-3 to R-3 Residence Development Plan. In the original RDP, the <br /> lots of Home Park Manor 3`d Addition were to be developed for single family units, meeting R-3 Single <br /> Family Residence requirements, with the exception of Lots 41, 42, 43, 44, and 45 which were to be <br /> developed as multi-family units. The City Council then approved a petition to amend the R-3 RDP in <br /> September of 1971 for Home Park Manor 4`h Addition. This allowed for an increase in multi-family units <br /> from 76 to 98 multi-family units while keeping the original 40 single family units for a total of 138 units. <br /> The petitioner proposes to amend the R-3 RDP in order to construct a duplex on Lot 22 of Home Park <br /> Manor 4"' Addition. The subject site is located in the 2300-2400 Block of North Florian Avenue and is <br /> currently vacant. The size of the proposed site is 16,000 square feet and is currently zoned R-3 Single <br /> Family Residence District RDP. If this lot were to be divided equally into two(2) lots, it would have a lot <br /> size of 8,000 square feet(minimum lot size of 6,000 square feet is required). The proposed development <br /> exceeds the R-3 lot size requirements creating a less dense development than could otherwise occur. <br /> The proposed use is compatible with the adjacent uses in the area. There are multi-family and single <br /> family units in the surrounding area as allowed by the RDP. The Decatur Urban Area Land Use Plan <br /> shows this area as Residential-Low Density. Staff is of the opinion that the construction of a duplex <br /> would still allow the land to be used in a low density function and it is in harmony with the City's <br /> Comprehensive Plan. Amending the R-3 RDP for the proposed construction of a duplex should not have <br /> an adverse effect of the surrounding area. <br /> POTENTIAL OBJECTION: There was a letter of objection sent to some Plan Commission members <br /> and then a copy was distributed to all in attendance at the Plan Commission Meeting. A copy of the letter <br /> of objection is attached. <br /> INPUT FROM OTHER SOURCES: The petition has been reviewed by the City's Technical Review <br /> Committee; Planning, Engineering and Fire have approved the petition. <br /> STAFF REFERENCE: Any additional questions may be forwarded to Suzan M.
