GIBBONS, hereinafter jointly referred to as "Trustors" and <br /> separately referred to as "Trustor", or as "Husband and Wife", and, SAMUEL E. <br /> GIBBONS and JEANETTE F. GIBBONS hereinafter referred to as "Trustee". <br /> 0 <br /> x IN CONSIDERATION of the mutual covenants contained herein, the parties <br /> hereto AGREE AS FOLLOWS: <br /> ARTICLE I <br /> TRUSTOR'S DESIRES <br /> 1.01 Designation of Trust. The Trust created hereby shall be known as the <br /> "SAMUEL E. and JEANET>-E F. GIBBONS FAMILY TRUST", and may also be designated <br /> by such number as the Trustee may determine. <br /> 1.02 Purpose of Trust. The Trustors desire to establish a mutual pian for the <br /> management, conservation and eventual disposition of their assets and intend by <br /> establishing this Trust to: <br /> (1) provide a means by which the Trustee can hold and manage their <br /> assets during their joint lifetimes and during the survivor's lifetime; <br /> (2) provide a receptacle for the receipt of assets from either of their <br /> estates, as well as for the receipt of proceeds from life insurance policies at the death <br /> of either or both Trustors. <br /> The Trust is primarily for the benefit of the income beneficiaries, as hereinafter <br /> provided, and the rights and interests of remaindermen are subordinate to that <br /> purpose. <br /> ARTICLE II <br /> TRUST PROPERTY <br /> 2.01 Initial Property. The Trustors do hereby transfer, convey and assign to <br /> the Trustee all the property on the attached Schedule. <br /> Such property shall constitute the initial trust estate and shall be held, <br /> administered and distributed by the Trustee as hereinafter set forth. <br />
