As used in this instrument, the masculine, feminine <br /> LL or neuter gender, and the singular or plural number shall each be deemed to include <br /> the others whenever the context so indicates. <br /> 8.03 Invalid Provisions. If any provision, sentence or clause of this Trust shall <br /> y be invalid, all of the remaining provisions, sentences and clauses thereof shall <br /> 00 nevertheless continue to be fully effective. <br /> ,M <br /> 8.04 Governing Law. Each Trust hereunder is an Illinois Trust, made in that <br /> State, and is to be governed, construed and administered according to its law. <br /> ARTICLE IX <br /> SUCCESSOR TRUSTEE AND CO-TRUSTEES <br /> 9.01 Resignation of Trustee. Any Trustee may resign at any time upon giving <br /> thirty (30) days' written notice, by certified or registered mail, to all adult beneficiaries <br /> and to the natural or legal guardians of any minor or incompetent beneficiaries who are <br /> or may then be entitled to receive payments hereunder. Such resignation shall take <br /> effect at the expiration of thirty (30) days from the date of mailing such notice. <br /> 9.02 Removal of Trustee. A Trustee may be removed at any time upon thirty <br /> (30) days' written notice to the Trustee by both Trustors during their joint lifetimes, or <br /> by the surviving Trustor after the death of either Trustor. <br /> incapaci1y of Trustee. IT a Trustee's attending physician certifies in <br /> writing that, in his judgment, the Trustee is physically or mentally unable to properly <br /> administer the Trust, such person shall be deemed incapacitated. In order for the <br /> remaining Trustee to act as sole Trustee, or in order for a Successor Trustee to act on <br /> behalf of the Trust, the remaining Trustee or the Successor Trustee must mail, by <br /> certified mail, return receipt requested, or by direct delivery, to the incapacitated <br /> Trustee, written notice of his removal, accompanied by the physician's report. The <br /> removal of the incapacitated Trustee shall take effect at the expiration of ten (10) days <br /> from the date of the notice's receipt by the incapacitated Trustee. The purpose of this <br /> provision if to provide for the removal of an incapacitated Trustee without having to file <br /> court proceedings. <br /> 9.04 Appointment of Successor Trustee. Upon the death, incapacity, <br /> resignation or removal of the Husband as Trustee, the Wife shall continue to act as <br /> Trustee; or upon the death, incapacity, resignation or removal of the Wife as Trustee, <br /> the Husband shall continue to act as Trustee.
