r <br /> V7 <br /> C incapacitated, resign or are removed, then ANNETTE CLOW, DUANE GIBBONS and <br /> LL ERRIN GIBBONS, shall act as Successor Trustees, and in the event one or more shall <br /> fail to become or cease to act, then the other or others shall act as Successor Trustee <br /> or Trustees. <br /> Upon the death, incapacity, resignation or removal of all Trustees and Successor <br /> 0 Trustees, then the adult beneficiaries of the Trust may nominate a Successor Trustee; <br /> and if there are no adult beneficiaries, then a court of competent jurisdiction shall have <br /> the right to appoint a Successor Trustee at the expense of the Trust. Each Successor <br /> Trustee shall have the same rights, duties, discretions and powers as are assumed and <br /> conferred in this Trust Agreement upon the original-named Trustee, unless relinquished <br /> as to the Successor Trustee under the provisions of this Agreement. <br /> 9.05 No Liability For Acts of Prior Trustee. A Successor Trustee, whether or not <br /> specifically named herein, shall not be responsible for the acts or omissions of any prior <br /> Trustee, and shall have no duty to audit or investigate the accounts or administration of <br /> any prior Trustee. <br /> 9.06 Co-Trustees. If there is more than one Trustee, the following provisions <br /> shall be controlling and shall be precedent over any other provisions relating to <br /> Trustees: <br /> A. Acts of Trustees. If there are two Trustees, both Trustees must act to <br /> bind the Trust. If there are three or more Trustees, then the act of a majority of the <br /> Trustees shall constitute the act of the Trustee. <br /> B. Delegation of Powers. A Trustee may delegate to another Trustee of this <br /> Trust any and all powers and discretions for limited periods of time. <br /> C. Acts of Co-Trustees. In the event that there are two or more Trustees, <br /> each Trustee shall be responsible only for his own acts or omissions in bad faith. <br /> D. Trustee Unable to Act. If any Trustee dies, resigns or is unable to act, <br /> then the remaining Trustee or Trustees shall administer the Trust. <br /> 9.07 Relinquishment. Any Trustee . may relinquish any and all powers or <br /> discretions in and by this Agreement vested in or imposed upon him or her, by <br /> delivering to the then-income beneficiaries or their natural or legal guardians an <br /> instrument, in writing, relinquishing such power or discretion. Any act done or decision <br /> made pursuant to such written instrument shall be binding upon and not subject to <br /> question or challenge by any person whatsoever.
