2010 Bonds, whether heretofore or hereafter taken or done, be, and the same hereby are, in all <br /> respects approved and confirmed. <br /> Section 14. That the Hospital will, pursuant to the Tax Exemption Agreement, <br /> designate the Series 2010 Bonds as "Qualified Tax-Exempt Obligations", pursuant to and as <br /> defined in Section 265(b)(3) of the Code; in accordance with Section 265(b)(3)(G) of the Code, <br /> the Series 2010 Bonds will not be taken into account in determining whether the City is eligible <br /> to designate other bonds or loans of the City as "Qualified Tax-Exempt Obligations." <br /> Section 15. That the City hereby approves the Financing Purposes, the plan of <br /> financing and refinancing and the issuance of the Series 2010 Bonds pursuant to Section 147(f) <br /> of the Code. <br /> Section 16. That the provisions of this Ordinance are hereby declared to be separable, <br /> and if any section, phrase or provisions shall for any reason be declared to be invalid, such <br /> declaration shall not affect the validity of the remainder of the sections, phrases or provisions. <br /> Section 17. That all ordinances, resolutions, orders or parts thereof, in conflict with the <br /> provisions of this Ordinance are, to the extent of such conflict, hereby repealed. <br /> Section 18. That this Ordinance shall be in full force and effect upon its passage and <br /> approval. <br /> PRESENTED, PASSED AND APPROVED AND RECORDED by the City Council of <br /> the City of Decatur, Macon County, Illinois this 1St day of November, 2010. <br /> AYES: Adam Brown, Jerry Dawson, Larry Foster, Dana Ray, Mayor Michael T.
