Excerpts from Plan Commission Minutes of June 3,2010 continued:
now they are going to have to contend with an Alzheimer unit. The safety issues are a big concern.
There are no break points, no fence, there is no privacy fence, nothing to keep them out of the pasture.
Currently, there is nothing in the area that is three (3) stories except the hotel across the street and they
are proposing to put in a three (3) story building on this property. This is a dramatic change in the
ambiance of the neighborhood.
Mr. Edwards said the second to the last picture is the back pasture which is about two and one-half(2
'/2) acres. You can see the natural valley and how the water runs. This is where he will have to deal
with the water running through. He realizes the retention basin will control the amount of volume that
goes through it. His concern is what type of damage this will do to the property. If the site is
developed it will push all the water that is being absorbed into that property now onto his property.
The facility will also bring in a high volume of ambulances and traffic. He does not see how a fire
truck will be able to drive around the facility.
Mr. Guy Casey, 2285 South Mt. Zion Road, was sworn in by Mrs. Poland.
Mr. Casey said he recently purchased the property next door to the proposed facility. His first point is
he feels the facility will totally destroy the neighborhood. Second point, the traffic is not going to be
controlled. Third point, the drainage issue as water will drain on his and Mrs. Sherman's property.
There is no way this is compatible with the business structures in the area.
Mr. Casey said the aerial overview he is referring to has been marked as exhibit three (3). He pointed
out his property and the proposed planned development. He said one of the requirements the
Commission has to consider is the compatibility with the existing neighborhood and environment. The
proposed three (3) story unit will be one hundred and fifty feet (150) from his residence. His property
is a four(4) area tract. Mr. Casey pointed out the neighbors lots.
Mr. Casey stated there is nothing in the area that is two (2) stories other than a residence and the three
(3) story structure in a B-2 complex which faces north and south. Mr. Casey said the residential area is
a very well kept area and an asset to the community. If this development is allowed, it will destroy the
ambiance of the area. The information he has states that an assisted living facility will cause the
surrounding property values to decrease by fifteen (15)percent minimum.
Mr. Casey will have no privacy as the facility will surround the back and the front of his property.
All nine (9) acres will be drained onto his, Mrs. Sherman's, and Mrs. Hines' properties. It will drain
until the detention pond is empty creating a muddy plain. If you go to Wal-Mart's pond, it is never
empty.
Mr. Casey said staff's recommendation said that IDOT will work with the developer. Staff did not tell
you that IDOT has already rejected parts of the proposal. The developer wants to put in banks with
drive-through facilities and IDOT said absolutely not. The plans are first submitted to IDOT and then
IDOT will approve, approve with modifications or not approve. IDOT has had the plans and no
approval has been given yet. The plans submitted cannot take place since they do not know if they will
have access off Route 121 or not.
Mr. Casey handed out a "Handbook for the Policy on Permits for Access Driveways to State
Highways"marked as exhibit two (2). The entry way the developer has drawn out is a fifteen(15) foot
radius. If you look at IDOT regulations they should have a thirty (30) to sixty (60) foot radius. The
problem is there is not enough room for the developer to do that.
