Excerpts from Plan Commission Minutes of June 3,2010 continued:
Section XIX.G.2. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a
public hearing to review the Planned Development plan and report its findings concerning the effect on
the comprehensive plan and compliance with the standards of review to the City Council. A motion to
forward Calendar Number 10-10 to the City Council with a recommendation for approval is suggested.
Mr. Steve Horve, Jr., petitioner, was sworn in by Mrs. Poland.
Mr. Horve stated his company has been developing assisted living centers around the state for the last
seven(7) years. In 2003, they developed Eagle Ridge on McKinley Avenue with seventy-six (76)beds
and it was full when it opened. Three (3) years ago thirty-seven (37) beds were added to it for a total
of one hundred and thirteen (113) beds and the facility is full with a waiting list. In the last seven (7)
years, they have developed twenty-five (25) projects similar to the proposed project.
Mr. Horve said the Department of Healthcare and Family Services has a program called Affordable
Assisted Living. In this program, people that are Medicare eligible and in need of assisted living are
able to come into one of these facilities where Medicare, food stamps and their social security are
accepted to help pay their bill. This is a very successful program.
Mr. Horve stated this is a wonderful location with shopping and restaurants close by as these facilities
usually have families that visit quite a lot.
Mr. Steve John asked what a memory care facility is. Mr. Horve said that a memory care facility is for
people who have memory loss and need extra care. They sometimes wander and are not aware of what
is going on. The plans are to build a thirty (30) unit memory care facility behind the assisted living
building. They have a facility in Litchfield that is like this and it works out very well as services can
be shared. There will be close to thirty (30) employees for the thirty (30) residents.
Mr. John asked if the north access road is a continuation of the road close to Rainstorm Carwash. Mr.
Horve said yes.
Mr. Brian Edwards was sworn in by Mrs. Poland.
Mr. Edwards passed out pictures of a property he is in contract to purchase located at 4750 East
Fitzgerald Road. Mrs. Sandy Sherman is the present owner of the property. Mr. Edwards said he has
some serious concerns about the proposed facility. He said the proposed development will be dumping
their catch basin on top of the ground which will drain into the valley located on the Sherman property.
Mr. Edwards said the picture shows the valley travels across most of the property.
Mr. Edwards stated the Sherman property is zoned for horses. He is concerned about a constant water
flow damaging the ground. They will also have a tall electrified fence on the property. In the plans
there are no trees or berm to block the property. What happens if a resident of the facility wandered
off the property and gets tangled up in his fence or with a horse? These are things that are affecting his
purchasing the property.
Mr. Edwards said his nextp icture is of an old drain tile. He was told Wal-Mart tried to connect into
this at one time. The drain tile was not in good enough condition to handle it and Wal-Mart had to
come in and re-tile it to go under the ground. Mr. Edwards said that Mrs. Sherman has some pictures
where you can see where the water dumped out.
Mr. Edwards said his next picture is from erosion cutting out around the farm tile. It is about a six (6)
foot by four(4) foot hole.
Mr. Edwards said this property has a beautiful view and you can only see Wal-Mart in one place.
Their berms and trees block it off from the neighborhood. These surrounding houses have big lots and
