Excerpts from Plan Commission Minutes of June 3,2010 continued:
is the second largest tree in the county. There are great horned owls on the property. This is a unique
area of Decatur. He does not want lights shinning into his bedroom from a three (3) story building.
Mr. Gibson does not want to be in the City limits of Decatur. He could possibly live with a one (1)
story facility, but he does not really want that either.
There should be a berm. The tree line will disappear. Are the neighbors going to have to run the
occupants off their property? He does not want this in his backyard. Mr. Gibson would like to know if
the big white oak tree will be saved. There is a retaining wall south of Fitzgerald Road on Mr. Ron
McGregor's property that has already been compromised by all the water that flows in that direction.
Mr. Frank Conaway, 4916 East Fitzgerald Road, was sworn in by Mrs. Poland.
Mr. Conaway just wanted to say he is against the proposed facility. It does not go with the ambiance
of the neighborhood. The drainage also goes from Mrs. Sherman's property to his. The creek was one
and a half(1 ''/2) feet wide and it is now four (4) to five (5) feet wide since Wal-Mart was built. He
thinks they need to do something other than discharge the water on the ground. He had pictures of the
creek.
Mr. Ron McGregor, 4828 Big Creek Drive, was sworn in by Mrs. Poland.
Mr. McGregor has been in Decatur forty-five (45) years. This is the property where the water ends up.
In his opinion, Big Creek is overloaded. The drainage will add more to the problem. The previous
owners built a retaining wall on his property. It has already been compromised. Big Creek eventually
ends up at Lost Bridge and Baltimore which was flooded last year. The big oak tree is something that
should be treasured. This is the wrong location for this facility.
Ms. Donna Stella was sworn in by Mrs. Poland.
Ms. Stella is concerned about the security. Her father was in Fairhaven Nursing home and he got out
several times through their security. She does not want anyone to get hurt. All of the nursing homes
have what they call runners. Ms. Stella is very upset about this proposed facility. She is afraid they
will have one hundred (100) eyes on them and patients in their yard. Mr. Casey would not have
bought this house if he knew this facility was going to go in next to him. This is a beautiful area. The
neighborhood's biggest investments are going to be trashed if this facility goes in.
Ms. Elaine Gibson, 2345 South Mt. Zion Road, was sworn in by Mrs. Poland.
Ms. Gibson moved into this property four(4) years ago. She loves her property and has no intention of
moving. She wants her property to stay as it is. Their home will no longer be what they fell in love
with. It is her dream spot.
Mr. John asked Mr. Horve to respond to the concerns of drainage, landscaping, building height and the
traffic concern. Mr.Horve asked the project engineer to respond to the drainage issue.
Mr. Chuck Guthrie, Professional Engineer with BWC, was sworn in by Mrs. Poland.
Mr. Guthrie said the drainage has been developed in accordance with the City policy and Codes.
Basically, they take the existing land area and determine what the three (3)year frequency storm runoff
is. That is the maximum that they can allow during a 100 year storm to get off the property after it is
developed. This has been done on the property by collecting in storm sewers and storing it into the
detention basin, which will be a dry basin, and then releasing it on top of the ground downstream from
the basin at the same rate that it would be released as conditions currently exist. Mr. Edwards asked if
this basically meant that there would be no additional runoff than what it does currently. Mr. Guthrie
said this was correct.
