'r
2
private corridor together with the proposed easement to avoid multiple
signals and controlled access onto Route 121, the lack of any traffic
controlled access points from the development onto Route 121, the
absence of any de-acceleration and acceleration lanes adjacent to the
proposed development and Route 121, etc.;
2. Substantial and unnecessary loss of residential property values
abutting, as well as, in the immediate vicinity to the proposed
development, i.e., unprecedented three (3) story structure abutting
the residential district, noise pollution (natural resource buffer
destroyed), emergency vehicle noise pollution, lighting intrusions, etc.;
3. Substantial and additional unnecessary drainage problems and issues,
i.e., discharging approximately nine (9) acres of surface water onto
adjoining property owners, as well as, the resulting adverse effects
upon the properties immediately south of the proposed site location;
4. Failure to either protect or preserve any semblance of the existing
natural resources or provide enhanced open spaces through the
proposed clustering together with an actual overuse of the site
location; and,
5. Failure to comply with existing zoning ordinance mandates concerning
such a site location, i.e., required buffer yards, prohibitive uses of
buffer yards (refuse containers, driveways, etc.), appropriate shielding
of site activities within 25 feet of the buffer yard, etc.
As a result of the above, in part, it is my understand that one of the
property owner has already needlessly suffered the loss of a contract for the sale
of their residence (Sandra Schuerman, 4750 E. Fitzgerald Road, Decatur, Illinois,
62521). As I commented before the Commission on June 3, 2010, there are
available alternative properties completely compatible with such a development
within our municipal boundaries; alternatives that don't result in the destruction
of a unique residential neighborhood, have no corresponding deficiencies and are
currently appropriately zoned for such proposed entities.
After the meeting on June 3, 2010, I engaged the services of David
Drobisch of Ed Drobisch & Company concerning an assessment of the numerous
deficiencies and adverse effects surrounding the proposed site development.
When he contacted the owner on the other side of Route 121, Mr. Roy B.
Mosser, Jr., he received the detailed response which I am forwarding herewith.
