,0 <br /> 3 <br /> 10 <br /> Excerpts from Plan Commission Minutes of July 1,2010: <br /> 61 <br /> ID <br /> m Cal.No. 10-14 Petition of GREGG MEISENHELTER, to vacate a <br /> portion of the Alleyway located in the 100 Block of <br /> rte. <br /> South Oakland Avenue. <br /> Ms. Suzy Stickle was sworn in by Mrs. Poland. <br /> Ms. Stickle presented the recommendation of staff: <br /> The petitioner is requesting vacating a portion of the alleyway in the 100 Block of South Oakland <br /> o Avenue. The vacation of the western 80 feet of the alleyway will enable the petitioner to create an <br /> outdoor patio for the adjacent restaurant much like what is currently being utilized across Oakland <br /> Avenue at Lock Stock and Barrel. <br /> All property owners adjacent to the entire alley as well as the garbage haulers for the area have been <br /> notified by the petitioner regarding the vacation and no objections have been expressed. The petitioner <br /> owns all other adjacent properties. <br /> Letters were sent to AmerenlP, Comcast Communications, and AT&T notifying the utility companies of <br /> the vacation request and no objections to the proposed alleyway vacation were expressed. <br /> An appraisal was conducted on the subject property. The proposed vacated property has an estimated <br /> market value of$1,000.00 which will be paid to the City. <br /> The formal vacation of a portion of this alleyway does not appear that it will have an adverse affect on the <br /> general public. A 20 foot ingress/egress easement has been recorded that will allow traffic to move <br /> between the alleyway and Main Street. The 20 foot easement is located east of the Winery building. <br /> Staff recommends approval of the alleyway vacation with the following conditions: <br /> 1. All easements shall be maintained. <br /> 2. Coordinate with the Fire Department prior to the installation of fencing. <br /> 3. Signage to assure safe travel from alleyway to Main Street shall be provided. Coordinate with the <br /> Public Works Department. <br /> 4. Remove drive approach, replace with curb and gutter and bring sidewalk boulevard to grade to <br /> match existing. Coordinate with Public Works Department. <br /> The Administrative Policy of the City of Decatur requires that property vacation requests be submitted to <br /> the Plan Commission for a public hearing. Although a Plan Commission recommendation is not required, <br /> a motion to forward the vacation request of Calendar Number 10-14 to the City Council with a <br /> recommendation for approval is suggested. <br /> Mr. John Mickler asked if the twenty (20) foot easement would be permanent. Ms. Stickle stated yes and <br /> it has already been recorded. <br /> Mr. Edwards asked if The Winery had any problems with any of this. Ms. Stickle said Mr. Meisenhelter <br /> is now the owner of The Winery. <br /> Mr. Steve John asked what Mr. Meisenhelter's plan was for The Winery's parking lot since currently you <br /> enter the parking lot, park at an angle and then leave through the alley. Ms. Stickle said vehicles would <br /> still be able to do that. Mr. John said instead of turning west into the alley vehicles would have to turn <br /> east into the alley and drive the entire length of the alley to Haworth. Ms. Stickle said this was correct. <br /> Mr. John feels this will generate quite a bit of traffic for the alley. Ms. Stickle stated all the neighbors on <br /> the alley have been notified and no objections have been expressed. <br />
