Excerpts from Plan Commission Minutes of July 1,2010 continued: �u Mr. John Mickler stated there is a package drive-up and feels this would be an area of congestion with the 1 angled parking. He does not see how traffic could get through. Ms. Stickle said the petitioner would be able to explain this. Mr. Phil Cochran, representative, said Mr. Meisenhelter does own The Winery and will be reversing the traffic flow. It will be one (1) way to the north. The package liquor will be on the driver's side. Mr. r+ Cochran said Mr. Meisenhelter has been buying properties along Oakland Avenue and improving them. 0 He would like to have outside seating for the pizza facility which is adjacent to the alley. This will be like 0 Lock, Stock and Barrel's outside seating area. There will be a wrought iron type fence you can see through. The Oakland Business Association is also supportive of this vacation. He also stated that there is more pedestrian traffic being generated with more businesses in the area. Traffic pulling out from the alley going over the sidewalk has become hazardous for pedestrians. The petitioner feels this is the best way to control the traffic and have pedestrian safety in the area. A permanent easement has been dedicated through The Winery parking lot that will route the traffic. All the neighbors have been notified and there were no objections. Mr. Edwards asked if traffic was going to be directed down Haworth, travel west through the alley and then turn north into The Winery where the parking spaces have been changed and the package liquor would be on the driver's side instead of the passenger side as it is now. Mr. Cochran said this was correct. Mr. Edwards asked how the notices to the residences were sent. Mr. Cochran said they were sent by registered mail to the property owners on record. Mr. Edwards asked if a vehicle was at the package liquor window and a vehicle was in the angled parking, would another vehicle be able to pass through. Mr. Cochran said there would not be enough room for another vehicle to pass through. Mr. Edwards asked if vehicles at The Winery drive-up could back up traffic in the alley. Mr. Cochran said if there were more than three (3) cars they would be out in the alley. Mr. Edwards said if there was an emergency,vehicles in the alley could inhibit police or fire response to the emergency. r making a long residential alley for a Mr. John said he was troubled by this. It seems to him that they are � � y driveway for The Winery. Mr. Cochran said the majority of the properties do not use the alley. The access to the alley is mainly used by garbage haulers who were notified of the possible change. There was no objection from either garbage hauler. Mr. John said at a busy time there could be a steady stream going down the alley of this residential block. He does not feel it is compatible. Mr. Cochran said there were no objectors and several of the properties are fenced in,with no alley access. Mr. John pointed out that trees have not been cut back and extend across the alley. It seems to him that the entire alley is being made The Winery driveway. There were no objectors present. It was moved and seconded (Dial/Mickler) to forward Cal. No. 10-14 to the City Council with recommendation for approval as presented by staff. Motion approved 4 to 2 to 1 with Shad Edwards and Steve John voting no, and Elayna Sadorus abstaining from the vote.
