A ' <br /> 'Memorandum of Understanding <br /> By and Between <br /> City of:Decatur, Illinois, and AFSCME Local 268 <br /> The City of:Decatur, Illinois, (Employer or City) and the American Federation of State, <br /> County and Municipal Employees (AFSCME), AFL-CIO, Council 31, Local .268 (Union) <br /> hereby agree to the following: <br /> 1. In addition to approved sick leave, vacation, holiday, funeral and <br /> emergency leave counting toward paid duty hours per week for the <br /> purpose of determining overtime compensation for employees <br /> represented by the Union, hours earned during the workweek as overtime <br /> and subsequently converted -to and taken as compensatory time will _be <br /> counted toward paid duty hours. <br /> 2. 'Based on the above agreement, item #1 of the Memorandum of <br /> Understanding between -the City and -the Union dated February 2, 2012, <br /> on this subject shall be modified and revised to read as-follows (addition <br /> underlined): <br /> "Members of the bargaining unit who are eligible for overtime pay <br /> will be paid at the rate of time and one-half their regular rate .of pay <br /> for all hours in excess of 40 paid duty hours during the work period. <br /> Overtime will not be based on time worked in excess of the normal <br /> 8 hour shift, but only on hours in excess of 40 per work period. <br /> Approved earned compensatory time, sick leave, vacation, holiday, <br /> funeral and emergency leave of which-the employee is paid will be <br /> counted toward the 40 paid duty hours per week. The work period <br /> begins Monday and ends Sunday." <br /> 3. All other terms of the Memorandum of Understanding between the City <br /> and the Union dated February 2, 2012, shall remain in full force and effect, <br /> and shall not be altered by the terms of this agreement. <br /> 4. This Memorandum of Understanding is a supplement to the current <br /> Collective Bargaining Agreement between the City and the Union, and as <br /> such, will be attached thereto and be made a part thereof. <br /> 5. The terms of this Memorandum of Understanding will be incorporated into <br /> the successor Collective Bargaining Agreement between the parties. <br /> 6. The Collective Bargaining Agreement between the parties and the <br /> arbitrator's award dated July 21, 2011, on this matter shall remain in full <br /> force and effect. <br /> 1 of 2 <br />
