5. The City agrees to create candidate registers for any and all bargaining unit employees <br /> who are scheduled for layoff in April 2010, and who can qualify for them through the Civil <br /> Service testing process. The registers shall be for any position classifications for which <br /> these individuals have an interest, and shall take precedence over any other current Civil <br /> Service registers (i.e., entry, promotional, or reinstatement) for these classifications, until <br /> the first of the following events occurs: <br /> a. a period of two years lapses; <br /> b. the register is exhausted; or <br /> c. the persons thereon are recalled to the positions from which they were originally <br /> furloughed. <br /> These individuals are provided 30 days from the date of layoff to test for any position <br /> classifications in which they have an interest, and shall be placed on the registers if they <br /> qualify for the positions. Individuals who have previously tested and have qualified for <br /> specific positions shall, with proof of prior qualification, be automatically placed on the <br /> registers for those positions. <br /> 6. The City and the Union agree that Article 8, Section 1, of the current collective <br /> bargaining agreement shall be supplemented so as to read as follows (new language is <br /> underlined): <br /> ARTICLE 8 <br /> Seniority <br /> Section 1. Except as defined elsewhere in the contract, seniority <br /> shall, for the purposes of the agreement, be defined as an employee's <br /> continuous length of service since the date of acceptance with the City in <br /> a position covered by this agreement. Seniority for full-time employees is <br /> determined by their ranking on the Civil Service register when more than <br /> one individual begins employment in a classification on the same day. <br /> The Union and the City agree that this concludes impact bargaining on the City budget for fiscal <br /> year 2010-2011, and that all other terms and conditions set forth in the May 1, 2006 through <br /> April 30, 2011 collective bargaining agreement between the parties shall remain in full force and <br /> effect. <br /> For the Union: For the City: <br /> Council 31 Representative Date City Manager Date <br /> 3- /9- .1 a At t: <br /> esident, Local 268 Date <br /> S /U <br /> City Clerk Date <br />
