DEVELOPMENT SERVICES MEMORANDUM
No. 10-39
May 12, 2010
TO: Honorable Mayor Michael T. McEp and City Council
FROM: Ryan P. McCrady, City Manager I^
Greg C. Crowe, Assistant City Manager
Suzan M. Stickle, Senior Planner 5
Joselyn A. Stewart, Transportation Planner.
SUBJECT: Vacation of the Watermain Easement in the 2200 Block of East William Street
SUMMARY RECOMMENDATION: Staff recommends approval of the watermain easement
vacation. The City Plan Commission voted 7-0 to recommend approval of this petition at the
May 6, 2010 meeting; the minutes of the meeting are attached.
BACKGROUND: The petitioner is requesting vacating a watermain easement in the 2200
Block of East William Street. The easement vacation will enable the petitioner to continue with
the redevelopment of their Retail Strip Shopping Center.
The City has requested that the existing watermain easement be vacated as the watermain has
been abandoned and is no longer in service. No appraisal for the easement vacation will be
required since the watermain is owned by the City and the City has requested that the petitioner
vacate.
The formal easement vacation will not have an adverse affect on the general public.
The easement is not necessary to serve the general public. Staff is of the opinion that the best
interests of the City of Decatur would be served by approving the easement vacation.
POTENTIAL OBJECTION: There were no known objectors at the Plan Commission
Meeting.
INPUT FROM OTHER SOURCES: The vacation has been reviewed by the City's Technical
Review Committee; Planning, Engineering and Fire have approved the vacation.
STAFF REFERENCE: Any additional questions may be forwarded to Joselyn A. Stewart at
424-2782 or at jstewartkdecaturil.gov.
BUDGET/TIME IMPLICATIONS: None.
