Excerpts from Plan Commission Minutes of May 6,2010: Cal. No. 10-07 Petition of NIEMANN FOODS, INC., to vacate the Watermain Easement located in the 2200 Block of East William Street. Mrs. Joselyn Stewart was sworn in by Mrs. Janet Poland. Mrs. Stewart presented the recommendation of staff: The petitioner is requesting vacating a watermain easement in the 2200 Block of East William Street. The easement vacation will enable the petitioner to continue with the redevelopment of their Retail Strip Shopping Center. The City has requested that the existing watermain easement be vacated as the watermain has been abandoned and is no longer in service. No appraisal for the easement vacation will be required since the watermain is owned by the City and the City has requested that the petitioner vacate. The formal easement vacation will not have an adverse affect on the general public. The easement is not necessary to serve the general public. Staff is of the opinion that the best interests of the City of Decatur would be served by approving the easement vacation. Staff recommends approval of the watermain easement vacation. The Administrative Policy of the City of Decatur requires that property vacation requests be submitted to the Plan Commission for a public hearing. Although a Plan Commission recommendation is not required, a motion to forward the vacation request of Calendar Number 10-07 to the City Council with a recommendation for approval is suggested. There were no questions and no petitioner nor objectors present. It was moved and seconded (Edwards/John) to forward Cal. No. 10-07 to the City Council with recommendation for approval as presented by staff. Motion carried unanimously.
