STAFF REPORT
Decatur City Plan Commission
COMMON NAME: Watermain Easement Vacation, 2200 Block of East William Street
GENERAL INFORMATION
Hearing Date May 6, 2010
Calendar No. 10-07
Property Location 2200 Block of East William Street
Requested Action Vacate the Easement in the 2200 Block of East William Street
Petitioner Niemann Foods, Inc.
Representative Phillip W. Cochran, PWC
LAND USE AND ZONING
Direction Existing Land Use Zoning Comprehensive Plan
Subject Property Commercial B-3 Commercial
North Commercial, Residential R-3, B-1, B-2 Commercial
South Commercial, Residential R-3, B-1, B-2 Commercial
East Residential R-3 Low Density Residential
West Commercial B-1, B-2 Commercial
BACKGROUND
1. The petitioner is requesting vacating a watermain easement in the 2200 Block of East William
Street. The easement vacation will enable the petitioner to continue with the redevelopment of
their Retail Strip Shopping Center.
STAFF ANALYSIS
1. The City has requested that the existing watermain easement be vacated as the watermain has been
abandoned and is no longer in service. No appraisal for the easement vacation will be required
since the watermain is owned by the City and the City has requested that the petitioner vacate.
2. The formal easement vacation will not have an adverse affect on the general public.
3. The easement is not necessary to serve the general public. Staff is of the opinion that the best
interests of the City of Decatur would be served by approving the easement vacation.
STAFF RECOMMENDATION
1. Staff recommends approval of the watermain easement vacation.
PLAN COMMISSION ACTION
1. The Administrative Policy of the City of Decatur requires that property vacation requests be
submitted to the Plan Commission for a public hearing. Although a Plan Commission
recommendation is not required, a motion to forward the vacation request of Calendar Number 10-
07 to the City Council with a recommendation for approval is suggested.
