Eaton, Recorder <br /> Book: 4063 Page: 679 1 <br /> k� Receipt c 31068 Recording_Fee: 135.00 <br /> 1„`79�s1.`�5 Pages Recorded: 9 Authorized By:y <br /> ate Recorded: 5/14/2010 9:24:28 AM <br /> ORDINANCE NO. 2010-13 <br /> ORDINANCE VACATING PROPERTY <br /> - 100 BLOCK OF SOUTH STATE STREET - <br /> WHEREAS, a request has been received from Tony Romano, requesting the vacation by <br /> the City Council of the 100 Block of South State Street, in the City of Decatur, Illinois described <br /> as: <br /> The Fifty-four (54) feet of State Street Right-of-Way between the South Right-of- <br /> Way Line of East Main Street and the North Right-of-Way Line of East Wood <br /> Street; and, <br /> WHEREAS, said street is no longer useful to the public or to the City or to the owner of <br /> the property abutting thereon as a public street; and, <br /> WHEREAS, the public interest will be subserved by vacating said public street and the <br /> public will be relieved from the further burden and responsibility of maintaining the same. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the street described above be, and the same is hereby, vacated as a public <br /> street inasmuch as the same is no longer required for public use and the public interest will be <br /> subserved by such vacation, said street being shown on the plat thereof hereto attached and <br /> hereby made a part hereof. <br /> Section 2. That the benefits which will be accrued to the owner of abutting property by <br /> reason of the vacation aforesaid is determined to be, in the judgment of the Council, equal to the <br /> sum of Forty-Seven Thousand Five Hundred Dollars ($47,500.00). <br /> Section 3. That the vacation herein provided for is made upon the express conditions <br /> that: <br />
