DEVELOPMENT PERMIT. No person, firm, corporation, or governmental body not <br /> exempted by law shall commence any development in the flood plain without first obtaining a <br /> development permit from the Assistant City Manager for Development Services Planning and Building <br /> Services Department . The Assistant City Manager for Development <br /> Services Planning and Building Services Department Gemmunity Development Aireet^r shall not issue <br /> a development permit if the proposed development does not meet the requirements of this <br /> chapter. <br /> vii. in addition to the above documents and materials, the Assistant City Manager for <br /> Development Services Planning and Building Services Department Community Development Difeet^" <br /> may require such of the following information as he/she may deem necessary for the evaluation <br /> of the effects of the proposal upon flood flows and flood plain storage and to render a decision <br /> on the proposed flood plain use, including: <br /> B. Whenever the standards of this Chapter place undue hardship on a specific <br /> development proposal, the applicant may apply to the Assistant City Manager for Development <br /> Services Planning and Building Services Department Community Development Dir-eet^" for a <br /> variance. The Assistant City Manager for Development Services Planning and Building <br /> Services Department shall review the applicant's request for a <br /> variance and shall submit his/her recommendation to the City Council. The City Council may <br /> attach such conditions to the granting of a variance as it deems necessary to further the intent of <br /> this chapter. In no instance shall the Council grant a variance which would allow construction at <br /> a level less than the minimum set forth by FEMA. <br /> D. The Assistant City Manager for Development Services Planning and Building Services <br /> Department Community Development Pir-eet^" shall notify an applicant in writing that a <br /> variance from the requirement of the building protection standards of Section 7 that would lessen <br /> the degree of protection to a building will: <br /> D.
