It shall be a violation of this Section for noise generated by the operation of <br /> a Wind Energy System to exceed a noise level of thirty (30dB) decibels as <br /> measured at any point along the propertylne. <br /> 5. Location. <br /> a. No Wind Energy Systems shall be erected within the front yard of any <br /> use. <br /> b. No part of a Wind Energy System (including blades) shall be located <br /> within or over any utility, water, sewer, or other type of easement. <br /> c. No part of a Wind Energy System including blades) shall be located <br /> within any required setbacks. <br /> 6. Multiple Wind Energy Systems. <br /> a. Multiple Wind Energy Systems may be allowed if they meet all <br /> regulations as required herein. The Wind Energy System must also <br /> maintain a setback from each other equal to the extended height of <br /> the structure. <br /> 7. Rooftop Wind Energy Systems. <br /> a. Wind Energy Systems designed to be installed on top of <br /> structures, must meet all regulations as required herein. <br /> 8. Force Wind Standards. <br /> a. The Wind Energy System must be engineered to withstand wind forces <br /> of up to 110 miles per hour. <br /> 9. Redundant Braking Systems. <br /> a. All Wind Energy Systems shall be equipped with a redundant braking <br /> system. This includes both aerodynamic over speed controls (includes <br /> variable pitch, tip, and other similar systems) and mechanical brakes. <br /> Mechanical brakes shall be operated in a fail-safe mode. Stall regulation_ <br /> shall not be considered a sufficient braking system for over speed <br /> protection. <br /> 10. Removal of abandoned wind energy systems. <br /> a. Within 180 days of notice that a Wind Energy System is inoperable the <br /> owner or occupant shall restore the Wind Energy System to full operating <br /> condition. It shall be a violation of this Section for any owner or occupant <br /> to fail to fully dismantle and remove a Wind Energy System that has been <br /> inoperable in excess of 180 days. The City of Decatur shall be authorized <br /> to remove any Wind Energy System that has been inoperable in excess of <br /> 180 days, at the owner's and/or occupier's expense and the costs of <br /> removal shall be a lien against the property.
