Excerpts from Plan Commission Minutes of November 5,2009 <br /> Cal. No. 09-49 Petition of NIEMANN HOLDINGS, LLC to rezone <br /> property located in the 2200 Block of East William <br /> Street from B-1 Neighborhood Shopping District to <br /> B-3 Planned Shopping Center District. <br /> Mrs. Joselyn Stewart was sworn in by Mrs. Janet Poland. <br /> Mrs. Stewart presented the recommendation of staff: <br /> The subject site is located in the 2200 Block of East William Street and is currently developed as <br /> a Retail Strip Shopping Center with a parking lot on approximately 4.23 acres. <br /> The petitioner proposes to rezone the parcel from B-1, Neighborhood Shopping District to B-3, <br /> Planned Shopping Center District in order to redevelop the site into a more modern aesthetically- <br /> pleasing retail strip shopping center. <br /> The proposed development has been designed in accordance with the attached conceptual site <br /> plan for commercial development of the site. In addition, the proposed plan provides for a <br /> unified landscape plan for frontage and parking. <br /> The proposed development has been designed to complement the adjoining neighborhood <br /> through landscaping, architectural features,pedestrian access and general orientation of the site. <br /> It has been determined by Engineering that a traffic impact report will not be required. <br /> Staff believes that the proposed development is compatible with the surrounding area and will <br /> have a positive impact on the neighborhood. A retail strip shopping center has been at this <br /> location for a number of years and it has not appeared to have had an adverse effect on the <br /> neighborhood. The plan is consistent with the comprehensive plan for commercial development. <br /> The existing streets are adequate to carry the anticipated traffic of the development. The <br /> proposed utilities are adequate to serve the development. <br /> The outside storage of merchandise, materials or equipment that would constitute a hazard or <br /> seriously interfere with vehicular or pedestrian traffic, or that would create a conflict between <br /> vehicular and pedestrian traffic is strictly prohibited. <br /> Access to the property is to be provided from East William Street, North 23`d Street and East <br /> North Street. Parking is sufficient to meet the needs of the center. Loading and unloading docks <br /> are adequate to serve the site. <br /> The plans include a proposed sign along East William Street. <br /> City water and sewers are currently provided to the site. <br /> The B-3 Planned Shopping Center plan has been reviewed by the City's Technical Review <br /> Committee; Planning, Engineering and Fire have approved the proposed plan. <br /> Staff recommends approval of the rezoning to B-3 Planned Shopping Center with the following <br /> condition: <br /> a. Final site, landscaping and lighting plans shall be submitted to and approved by the <br /> Economic and Urban Development Department, the Department of Public Works and <br /> the Fire Department prior to building permits being released. <br />
