Excerpts from Plan Commission Minutes of November 5,2009 continued: <br /> Section XIII. requires the Plan Commission to hold a public hearing to review a Planned <br /> Shopping Center District, and then forward its report and recommendation to the City Council <br /> for final approval. A motion to forward Calendar Number 09-49 to the City Council with a <br /> recommendation for approval is suggested. <br /> Mr. Phil Cochran, representative, was sworn in by Mrs. Poland. <br /> Mr. Cochran stated that the Pines Shopping Center has been a shopping retail center since the <br /> 1950's and very little has been done to update or upgrade the area. If the petition is approved it <br /> would bring the center into a more aesthetically pleasing retail shopping center. <br /> Mr. Cochran said that Niemann Holdings has a contract to purchase this property. The contract <br /> has several items that must be met before the contract is completed. One of these items is that <br /> the site be developed in accordance with the proposed plan that was submitted. <br /> Mr. Cochran stated that Niemann Holdings handed out flyers to the adjacent neighbors and <br /> posted signs giving the date of an informational meeting that was held at the Civic Center. There <br /> were no adjacent neighbors that showed up at the meeting. The Save-A-Lot manager had a few <br /> inquiries but there was no objection voiced to him. <br /> The improvements will be made in phases. The parking lots will be upgraded with new lighting <br /> and landscaping which meets or exceeds the City requirements. The initial development phase <br /> will begin during the 2010 construction season. The first building will be built in the far east of <br /> the lot and the existing Save-A-Lot will remain open during this construction. The old store will <br /> be torn down once the new store is finished. As other clients and tenants come along new <br /> buildings will also be built. This will be done in two (2) or three (3) phases of construction. Mr. <br /> Cochran believes this is certainly an improvement to the area and to the major thoroughfares of <br /> the City. <br /> Mr. Matt Dial asked for an explanation of a TIF District. Assistant City Manager, Greg Crowe, <br /> gave a brief summary. <br /> Ms. Elayna Sadorus asked if the City had any time constraints on the phasing of the <br /> development. <br /> Mr. Rich Niemann Jr., president and CEO of Niemann Foods, was sworn in by Mrs. Poland. <br /> Mr. Niemann said there are three (3) existing tenants that are in the shopping center now. There <br /> is a variety of leases involved. Neimann is hoping to have the development finished in two (2) <br /> years but it might take as many as three (3). One (1) tenant has two (2) more years left on their <br /> lease which is how the three (3) year window would be in effect. Another tenant has multiple <br /> options but Niemann would be allowed to move them. <br /> Ms. Sadorus asked what the exterior finish would be. Mr. Niemann said it would be mostly a <br /> metal building. Ms. Sadorus asked if the City had a say in the exterior of the building since this <br /> was not in a Planned Development District. Mr. Crowe stated since this is a Planned Shopping <br /> Center District, the Plan Commission and staff can make recommendations about the exterior. <br /> Staff did review the exterior and felt this was an appropriate exterior finish for the type of <br /> shopping center for the area. <br /> Mr. Steve John asked if there was any provision in the Ordinance about the phasing for plans that <br /> are submitted. Mr. Crowe said the Planned Development is just one part of this redevelopment. <br />
