� x ORDINANCE NO. 2009-62 ORDINANCE GRANTING CONDITIONAL USE PERMIT - 4700 BLOCK EAST MARYLAND STREET - WHEREAS, on the 6th day of August, 2009, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Dan Dougherty, for a conditional use permit under the provisions of Section XXII.A.3 of the Zoning Ordinance to allow the operation of a car wash on property located in the City of Decatur, Illinois and legally described as follows: A part of Lot Five (5) of JDN Addition as per Plat recorded in Book 1832, Page 757 of the records in the Recorder's Office of Macon County, Illinois, said part described as follows: Commencing at the Northeast corner of said Lot Five (5) of JDN Addition; thence N89°30'21"W (Assumed Bearing) along the North line of said Lot 5, 328.68 feet; thence S00°29'39"W, 26.52 feet to the Point of Beginning; thence S89°27'29"E, 248.24 feet; thence on a curve to the right, having a radius of 25.00 feet, an arc distance of 39.25 feet having a chord with a bearing of S44'29'1 I"E and a distance of 35.34 feet; thence S00°29'06"W, 123.99 feet; thence on a curve to the right having a radius of 25.00 feet, an arc distance of 39.16 feet having a chord with a bearing of S45°21'40"W and a distance of 35.28 feet; thence N89°45'46"W, 248.25 feet; thence N00°27'42"E, 175.31 feet to the Point of Beginning, containing 1.088 acres, more or less; and, WHEREAS, said Decatur City Plan Commission recommended that such conditional use permit be approved. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the recommendation and report of the Decatur City Plan Commission be, and the same are hereby, received, placed on file and granted.
