No. 09-35 Petition of DAN DOUGHERTY — RAINSTORM <br /> CAR WASHES for a Conditional Use Permit in the <br /> B-2 Commercial District in the 4700 BLOCK OF <br /> ALDI DRIVE to allow for an automatic carwash. <br /> Ms. Ashe presented the recommendation of staff: <br /> The subject site is located in the 4700 Block East Maryland Street, contains approximately 1.10 <br /> acres, and is currently undeveloped. The subject area is presently zoned B-2, Commercial <br /> District. The subject petition requests a conditional use permit to allow for the construction of a <br /> state of the art Rainstorm Car Wash. <br /> The proposed building will be 5,333 square feet in area. It will contain a single bay in which the <br /> vehicles will drive through. The drive up lane will accommodate ten (10) vehicles which feed <br /> from two (2) lanes into one (1). There will be a `Shine Building' which can accommodate five <br /> (5) stacking spaces for a car wax job. Additionally, there will be sixteen (16) vacuum stalls with <br /> sixteen (16) vacuums. <br /> Staff supports the proposed Conditional Use Permit. Staff believes the proposed use of a <br /> carwash on this particular lot is compatible with the B-2 zoning as well as the neighboring <br /> commercial uses. <br /> According to Section XXII.A.3. there are three standards which must be met in order to grant a <br /> conditional use permit. The first standard requires that the use be "necessary for the public <br /> convenience at the location." The proposed use is generally compatible with the neighborhood <br /> along East Maryland Street and the surrounding Wal-Mart development and the car wash will <br /> provide a service which can be utilized by area residents. The proposed use also meets the <br /> second standard. The facility is located and designed to be operated in a manner in which the <br /> public health, safety and welfare will be protected. Last, the facility does not appear it will cause <br /> substantial injury to the value of other properties in the neighborhood as stated by the third <br /> standard. The proposed carwash will be located between a commercial development and a bank <br /> in addition to being part of the Wal-Mart development. The structure will be required to meet all <br /> applicable City codes and standards. <br /> The Conditional Use Permit has been reviewed by the City's Technical Review Committee. <br /> Planning, Engineering, and Fire have all approved the proposed development. <br /> Based on the analysis, staff recommends approval of the petition as submitted with the following <br /> conditions: <br /> a. Provide discharge rates for review and approval by the Public Works Department. <br /> b. All plantings at the time of installation shall meet the requirements of the Zoning <br /> Ordinance. <br /> c. Site plans must be submitted to and approved by the Economic and Urban Development <br /> Department, the Public Works Department and the Fire Department. <br />
