ORDINANCE NO. 2009-43 ORDINANCE AMENDING B-3 PLANNED SHOPPING CENTER DISTRICT - 245 WEST FIRST DRIVE - WHEREAS, on the 4th day of June, 2009, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Mark Allen, to modify and amend the 13- 3 Planned Shopping Center District, as previously amended by Ordinance No. 2009-18, on premises situated in the City of Decatur, Illinois, and described as follows: A part of Lot 3 of South Shores 5th Addition to the City of Decatur, as per plat recorded in Book 300, Page 159 of the Records in the Recorder's Office of Macon County, Illinois, said part more particularly described as follows: Commencing at the Northeast Corner of Lot 3, South Shores 5th Addition; thence South 83°47'26" West 382.00 feet (Rec.), 380.78 (Mea.) along the South right of way line of West 1St Drive to a point for a place of beginning; thence continuing South 83°47'26" West along said South right of way line a distance of 154.46 feet; thence South 04°03'24" East a distance of 276.35 feet, to a point on the North boundary line of South Shores 2nd and 4th Additions said point also beim 2.79 feet West of the Northwest Corner of Lot 21, of said South Shores 4t Addition; thence North 74°39'24" East along said North Boundary line of South Shores 2nd and 4th Additions, 230.68 feet; thence North 20°55'32" West, 247.66 feet to the place of beginning; and, WHEREAS, the Decatur City Plan Commission did report its findings and did recommend that the modification of said Planned Shopping Center District as requested be authorized. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the report and recommendation of the Decatur City Plan Commission be, and the same is hereby, received, placed on file and approved.
