Excerpts from Plan Commission Minutes of June 4, 2009 <br /> Cal.No. 09-26 Petition of MARK ALLEN, to amend the B-3 <br /> Planned Shopping District located at 245 WEST <br /> FIRST DRIVE to increase square footage of <br /> proposed retail/restaurant facility. <br /> Ms. Stephanie Ashe was sworn in by Mrs. Janet Poland. <br /> Ms. Ashe presented the recommendation of staff: <br /> The 1.14 acre subject site is currently vacant and is zoned B-3 Planned Shopping Center District <br /> and has been zoned as such since the 1960s. In 1998, it was amended to include more property <br /> to the north. In 2008, the previous building (Arby's fast food chain) was demolished. In April <br /> of 2009, the site was approved for the construction of a dual-use commercial/retail and <br /> restaurant/drive-thru facility. <br /> The subject petition requests that the B-3 be amended to allow for approximately five-hundred <br /> (500) more square feet for a total of 6,600 square feet as potential tenants have requested larger <br /> space. The originally approved parking and landscaping will remain and will still meet the <br /> requirements of the Zoning Ordinance even with the additional square footage. <br /> The proposed amendment to the B-3 is consistent with the character of the surrounding <br /> neighborhood and general area. The B-3 is consistent with the intent of the original B-3 and the <br /> Comprehensive Plan. <br /> Staff recommends approval of the amendment to the B-3 Planned Shopping District with the <br /> following amendments: <br /> a. Relocate south handicap parking space to be closest accessible space to the south door. <br /> b. Provide a curb or bumper blocks. <br /> c. Truncated domes should be placed where a sidewalk leads to a vehicular path of <br /> travel. <br /> d. Final site plans and construction plans shall be submitted to and approved by the <br /> Economic and Urban Development Department and the Department of Engineering <br /> and Infrastructure prior to the issuance of a building permit. <br /> The proposed site plan has been reviewed by the City's Technical Review Committee; Planning, <br /> Engineering and Fire have approved the proposed plan. <br /> According to Section XXIX.G. of the Zoning Ordinance the Plan Commission shall review the <br /> application at a public hearing and will make findings concerning the consistency of the <br /> application with the Comprehensive Plan, the Zoning Ordinance and other land development <br /> regulations. Based on the findings, the Plan Commission will make a recommendation to the <br /> City Council. A motion to forward Calendar Number 09-26 to the City Council with a <br /> recommendation for approval is suggested. <br /> Mr. Shad Edwards asked for an explanation of truncated domes. <br /> Mrs. Mary Cave was sworn in by Mrs. Poland. <br />
