h <br /> MACON COUNTY BOARD RESOLUTION <br /> TO APPROVE AND ADOPT AN EXTENSION OF <br /> THE INTERGOVERNMENTAL AGREEMENT BETWEEN <br /> THE CITY OF DECATUR AND MACON COUNTY <br /> REGARDING THE ANIMAL CONTROL PROGRAM <br /> RESOLUTION NO. G-3603-7-11 <br /> WHEREAS, pursuant to the Animal Control Act (5 10 ILCS 511 et seq.). the Humane Care for Animals Act (5 10 <br /> ILCS 70/1 et seq.), and the Animal Welfare Act (225 ILCS 605/1 et seq.), the County Board of Macon County is <br /> required to maintain an Animal Control Program in Macon County; and <br /> WHEREAS, the County Board may enter into intergovernmental contracts or agreements to assist in the operation <br /> and to modify the jurisdiction of the Animal Control Program: and <br /> WHEREAS, through the implementation of a shared data base the animal control efforts of both the City of Decatur <br /> and Macon County will be improved; and <br /> WHEREAS, by the City of Decatur and Macon County joining together in administering an Animal Control <br /> Program, the citizens of Macon County and the City of Decatur shall be afforded the protection of an effective <br /> program without the duplication of efforts which are found with each party operating a separate program. and <br /> substantial benefits in the operation of animal control efforts will accrue to the citizens of both the City and the <br /> County; and <br /> WHEREAS, the City and the County have previous]-,, entered into an Intergovernmental Agreement dated January <br /> 22, 2007 regarding the Animal Control Program. and the parties desire to replace such agreement: and <br /> WHEREAS, the County has given a Notice dated April 14, 2011 to terminate said intergovernnjental A_reement <br /> regarding the Animal Control Program effective July 31. 2011. said notice being served on the City on April 18. <br /> 2011;and <br /> WHEREAS, the City and the County have been in negotiations with a desire to reach an agreement on a new <br /> animal control agreement, but additional time is needed to complete the negotiations, and thus the parties desire to <br /> extend the presently existing animal control agreement. <br /> NOW, THEREFORE, BE IT RESOLVED that the Macon County Board approves the Extension Agreement to <br /> the presently existing Intergovernmental Agreement as attached hereto. <br /> BE IT FURTHER RESOLVED that the Chainnan of the Macon County Board is authorized to sign on behalf of <br /> the County of Macon said Extension Agreement. <br /> BE IT FURTHER RESOLVED that this resolution shall become effective upon the adoption thereof. <br /> PRESENTED,PASSED,APPROVED this 14th day of July,2011 <br /> AYES 18 NAYS 1 FILED MACON COUNTY BOARD <br /> MACON COUNTY, ILLINOIS <br /> ATT S JUL 15 2011 BY: <br /> Stephen M.Bean <br /> County Clerk c <br /> Macon County a , <br /> Stephen M.
