INTERGOVERNMENTAL AGREEMENT This Agreement is made between the City of Decatur, Illinois, ("City"), a municipal corporation, and the Decatur Park District ("Park"), a body politic and corporate and a unit of local government. WHEREAS, the City and Park are units of local government, as defined by Article VII", Section 1 of the Constitution of the State of Illinois ("Constitution"); and, WHEREAS,the City and Park are authorized and empowered by Article VII,Section 10 of the Constitution and the Intergovernmental Cooperation Act, 5 ILCS 220/1 et. seq.,to enter into intergovernmental agreements; and, WHEREAS,the creation of Lake Decatur ("Lake") in 1921 was a pragmatic endeavor with the primary purpose of ensuring a dependable water source for industry and business; and, WHEREAS,the City and Park agree that there exists a need to enhance the community's quality of life and assist and promote industry and business; and, WHEREAS, the City and Park each own, control or maintain areas of the Lake or property and structures upon, adjoining or adjacent to the Lake; and, WHEREAS,the City and Park agree that the Lake and the adjoining land is one of the community's most valuable assets; and, WHEREAS,the City and Park agree that it will be in the public interest to develop the Decatur Lake Front with a wide array and spectrum of facilities and activities to benefit the public, industry and business. NOW, THEREFORE, for and in consideration of the promises and covenants made herein and for their mutual benefit and the benefit of the public, industry and business,the City and the Park agree as follows: SECTION 1: PURPOSE A. To develop the Decatur Lake Front ("Development") with cultural, educational, and recreational facilities and activities; B. To enhance the quality of life for the members of the community; C. To support industry and business; D. To promote tourism.
