The Professional Service Provider expressly acknowledges, recognizes and agrees that the only <br /> authority to approve change orders to this Agreement or the Scope or Services or the cost(s)therein is <br /> with the City Council of the City. <br /> SECTION II. BASIC SERVICES <br /> A. STUDY AND REPORT PHASE. Not part of this agreement. <br /> B. PRELIMINARY DESIGN PHASE. Not part of this agreement. <br /> C. FINAL DESIGN PHASE. Not part of this agreement. <br /> D. BIDDING PHASE. Not part of this agreement. <br /> E. CONSTRUCTION SURVEY AND LAYOUT PHASE. Not part of this agreement. <br /> F. CONSTRUCTION INSPECTION PHASE. <br /> The Professional Service Provider shall,after written authorization to proceed with the Construction <br /> Inspection Phase: <br /> 1. General Duties. The Professional Service Provider shall consult with and advise the City's <br /> Representative and act as its representative as provided herein and in the General Conditions of <br /> the construction contract for the Project. The primary responsibility of the Professional Service <br /> Provider in this phase of the work shall be quality control inspection of the materials,construction <br /> methods and techniques to assure that the Contractor builds the project in accordance with the <br /> plans and specifications. <br /> 2. Construction Inspection and Reporting. The Professional Service Provider shall make visits to <br /> the site at intervals appropriate to the various stages of construction to observe as an experienced <br /> and qualified design professional the progress and quality of the executed work of the Contractor <br /> and to determine in general if such work is proceeding in accordance with the Contract <br /> Documents. During such visits and on the basis of on-site observations,the Professional Service <br /> Provider shall keep the City's Representative informed of the progress of the work, shall <br /> endeavor to guard the City against defects and deficiencies in such work and may disapprove or <br /> reject work failing to conform to the Contract Documents. Formal notification of the progress of <br /> work shall be in the form of bi-weekly project progress meetings held between the Professional <br /> Service Provider,Contractor and City's Representative. Project schedule updates shall be <br /> submitted to the City's Representative in writing. <br /> 3. Review of Technical and Procedural Aspects. The Professional Service Provider shall review and <br /> approve(or take other appropriate action in respect to Shop Drawings,the results of tests and <br /> inspections and other data which each Contractor is required to submit,determine the <br /> acceptability of substitute materials and equipment proposed by the Contractor(s), and receive <br /> and review(for general content as required by the Specifications)maintenance and operating <br /> instructions, schedules, guarantees, bonds and certificates of inspection which are to be <br /> assembled by the Contractor(s). <br /> 4. Contract Documents. The Professional Service Provider shall receive from each Contractor and <br /> review for compliance with contract documents all required document submissions including but <br /> not limited to Performance and Payment Bonds, certificates of insurance report forms required by <br /> any City, State or Federal law,or rule or regulation and submit the forms to the City's <br /> Representative for final approval. <br />
