Marley, P.E., Public Works Director VV\Gi-t> <br /> SUBJECT: Agreements with Archer Daniels Midland Corporation for the Installation of <br /> Public Water and Sanitary Sewer to Serve their Rail Yard Expansion <br /> Development on the Northeast Side of Decatur <br /> SUMMARY RECOMMENDATION: <br /> It is recommended that the City Council authorize agreements with Archer Daniels Midland <br /> Corporation(ADM)to install public water and sanitary sewer as part of their development of the <br /> area north of Faries Parkway and west of Brush College Road. The Resolutions authorize the <br /> Mayor to execute the Agreement and for the City Clerk to attest. <br /> PRIOR COUNCIL ACTION: <br /> There has been no prior Council action on this item. <br /> BACKGROUND: <br /> In June 2010, Archer Daniels Midland Corporation(ADM) began the construction of a rail yard <br /> in the area west of Brush College Road and north of Faries Parkway. A Railroad Operations <br /> building was added to the scope of the project. Water and sewer service are required to serve the <br /> proposed building. <br /> Staff has reviewed and approved the construction plans for the sanitary sewer and watermain <br /> project. The proposed work includes the construction of 350 feet of public 12"watermain and <br /> 315 feet of 10"public sanitary sewer. ADM's general contractor, Ryan Inc., and their <br /> subcontractor, DF Tomasini, Inc. will be constructing the improvements. <br /> One resolution allows the City to enter into an Agreement with ADM that sets forth the rights <br /> and responsibilities of the construction and maintenance of the public water and sewer main <br /> extensions in an existing utility easement. <br /> Approximately the east 40 feet of the water and sewer main extensions are on property owned by <br /> ADM and not in a utility easement. After the construction of these extensions, ADM will grant a <br /> utility easement to the City for the maintenance of the public utilities. A second resolution allows <br /> the City to enter into an Agreement with ADM that sets forth the right and responsibilities of the <br /> Page I 1 <br />
