u V <br /> ` r a <br /> AGREEMENT BETWEEN <br /> CITY OF DECATUR, ILLINOIS <br /> AND <br /> NATGUN CONCRETE TANK SERVICES <br /> This AGREEMENT is made on and entered into this Cx7 day o �`�` , <br /> w n f D Illinois an Illinois Munici al Co or ion herein <br /> 2011 by and bet ee the Crty o ecatur, , p ( <br /> referred to as "City") and Natgun Concrete Tank Services (hereinafter referre as"Natgun"). <br /> WHEREAS, the City owns a Water Storage Tank, including prestressing wire located <br /> thereon ("Tank") located in Decatur, Illinois, and; <br /> WHEREAS, said equipment is in need of inspection, repair, and maintenance performed, <br /> and; <br /> WHEREAS, the City desires to engage the services of Natgun to inspect, repair and <br /> perform maintenance on said equipment. <br /> NOW THEREFORE, in consideration of the mutual promises and mutual covenants and <br /> obligations of the parties contained herein, and other good and valuable consideration, the receipt <br /> and sufficiency whereof are hereby acknowledged, set out herein,the City and Natgun, intending <br /> to be legally bound, mutually agree to the following terms and conditions. <br /> A. Duties of Natgun <br /> Natgun agrees to thoroughly inspect and sound the exterior of the Tank wall to locate any <br /> exposed or corroded prestressing wire located on the Tank. Natgun will inspect each <br /> individual wire to determine the integrity. Natgun agrees to repair and retain up to fifteen <br /> (15) corroded or broken prestressing wires to the original design stress and reinstall the <br /> covercoat using either high strength patching material or shotcrete to match the <br /> surrounding material of the Tank. <br /> If additional broken and corroded prestressing wires are found by Natgun, they will be <br /> repaired to the original design stress and covercoat reinstalled using either high strength <br /> patching material or shotcrete to match the surrounding material of the Tank. <br /> Natgun agrees to provide all engineers, technicians, equipment, travel and expenses <br /> necessary to fully complete the work outlined in this Agreement with the costs of such <br /> included in the Agreement cost as set forth below. <br /> B. Location and Time <br /> All work to be performed by Natgun under this Agreement shall be performed at <br /> the location of the Tank located in Decatur, Illinois by July 31, 2011. <br /> The parties agree that time is of the essence of this Agreement. <br />
