C. Duties of City The City agrees to: 1. Provide access to the Tank site and provide a level, stable work area. 2. Provide construction power and wash water. 3. Remove all construction debris and concrete rubble. 4. Restore the site to the desired condition. D. Compensation The City shall pay to Natgun the total sum of Seventeen Thousand Five Hundred Dollars and No Cents ($17,500.00) for performance of the services by Natgun as set forth above. If additional broken and corroded prestressing wires are found on the Tank, they will be repaired as described above at the price of Six Hundred Dollars and No Cents ($600.00) per wire. Any additional labor required to implement any repairs or work outside of the work outlined in this Agreement shall be performed only at the City's written direction and authorization. E. Termination The City may cancel this Agreement at any time due to the failure of Natgun to perform any portion thereof. In such event, the City shall pay Natgun only for that work actually performed. F. Conflict of Interest Natgun certifies that to the best of its knowledge, no employee, agent, officer or director of the City is interested in this Agreement or has any pecuniary interest in Natgun or this Agreement, and that no person associated with Natgun has any interest that would conflict in any manner or degree with the performance of this Agreement. G. Indemnity and Hold Harmless Natgun shall indemnify, defend, save and hold harmless the City, its officers, employees, directors and agents, in both their individual and official capacities, from any and all liability, losses, attorneys' fees or other costs of defense, expenses, demands, claims, damages, proceedings or causes of action of any kind or nature, including but not limited to those pertaining to any federal or state environmental statutes or regulations that the City may suffer, incur, sustain or become liable for due to any injury to, or death of, any
