C. Duties of City <br /> The City agrees to: <br /> 1. Provide access to the Tank site and provide a level, stable work area. <br /> 2. Provide construction power and wash water. <br /> 3. Remove all construction debris and concrete rubble. <br /> 4. Restore the site to the desired condition. <br /> D. Compensation <br /> The City shall pay to Natgun the total sum of Seventeen Thousand Five Hundred Dollars <br /> and No Cents ($17,500.00) for performance of the services by Natgun as set forth above. <br /> If additional broken and corroded prestressing wires are found on the Tank, they will be <br /> repaired as described above at the price of Six Hundred Dollars and No Cents ($600.00) <br /> per wire. <br /> Any additional labor required to implement any repairs or work outside of the work <br /> outlined in this Agreement shall be performed only at the City's written direction and <br /> authorization. <br /> E. Termination <br /> The City may cancel this Agreement at any time due to the failure of Natgun to perform <br /> any portion thereof. In such event, the City shall pay Natgun only for that work actually <br /> performed. <br /> F. Conflict of Interest <br /> Natgun certifies that to the best of its knowledge, no employee, agent, officer or director <br /> of the City is interested in this Agreement or has any pecuniary interest in Natgun or this <br /> Agreement, and that no person associated with Natgun has any interest that would <br /> conflict in any manner or degree with the performance of this Agreement. <br /> G. Indemnity and Hold Harmless <br /> Natgun shall indemnify, defend, save and hold harmless the City, its officers, employees, <br /> directors and agents, in both their individual and official capacities, from any and all <br /> liability, losses, attorneys' fees or other costs of defense, expenses, demands, claims, <br /> damages, proceedings or causes of action of any kind or nature, including but not limited <br /> to those pertaining to any federal or state environmental statutes or regulations that the <br /> City may suffer, incur, sustain or become liable for due to any injury to, or death of, any <br />
