t ' , , K. Independent Contractor Natgun shall be an independent contractor and not an employee of the City, and nothing contained or written herein shall be construed to the contrary. L. Licenses and Permits It shall be the responsibility of Natgun to obtain any and all licenses and permits required to conduct the work set forth in this Agreement. M. Freedom of Information Act All documents and records in the possession of Natgun, its sub-contractors and any other person employed by Natgun or its sub-contractor to perform any act or function pursuant to this Agreement which act or function shall be considered a governmental function on the City's behalf and directly related to the governmental function of the City, are subject to the provisions of the Illinois Freedom of Information Act. Natgun agrees to fully cooperate with the City to ensure the City's compliance with the Freedom of Information Act and agrees to indemnify and hold the City harmless for any failure by Natgun to comply with the provisions of said Act. N. Prevailing Wage Rate The general prevailing rates of wages for the locality shall be paid for each craft or type of worker or mechanic needed to execute this Agreement or perform such work as stated in the Illinois Prevailing Wage Act (820 ILCS 130/1 et. se�c.) and Natgun agrees to comply with said Act as well as comply with the Prevailing Wage Act Policy of the City, attached hereto, marked Exhibit A and incorporated by reference. O. Federal Laws Natgun agrees to comply and to require compliance by any and all of its sub-contractors of any and all applicable federal laws and regulations, including but not limited to the Davis-Bacon Act, the Contract Work Hours, the Safety Standards Act, and the Copeland Anti-Kickback Act, and shall maintain documentation which demonstrates compliance with such. Such documentation shall be made available to the City for review upon request by the City. P. Equal Employment Opportunities Natgun agrees to comply and to require any and all of its sub-contractors to comply with the provisions of the Illinois Human Rights Act or the Rules and Regulations of the Illinois Department of Human Rights ("Department"), the provisions of the Human Relations Code of the City of Decatur and Equal Employment provisions set forth in the notice attached hereto, marked Exhibit B and incorporated herein by reference.
