� � <br /> 7URISDICTIONAL TRANSFER <br /> AGREEMENT <br /> This Agreement is entered into this �7T`r day of .T�r��a , A.D., 20!� by and between the <br /> STATE OF ILLINOIS, acting by and through its DEPARTMENT F TRANSPORTATION, hereinafter called <br /> the STATE, and the City of Decatur in Macon County, the State of Illinois, hereinafter called the City. <br /> WITNESSETH <br /> The AGREEMENT will be identified as: <br /> • STATE Job Number C-97-008-11 and City Section 10-00001-00-JT, and <br /> • PPS Number 7-50373-0000 (FY 11) <br /> NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree <br /> as follows: <br /> I.) THE CITY AGREES: <br /> 1. Funds received through this AGREEMENT will be deposited into the City's Motor Fuel Tax <br /> account and expended in accordance with Motor Fuel Tax standards, policies and procedures. <br /> 2. If applicable, to maintain, for a minimum of three (3) years after the completion of any <br /> contracts, adequate books, records and supporting� documents to verify the amounts, recipients and uses <br /> of all disbursements of funds passing in conjunction with the contract. The contract and all books, <br /> records and supporting documents related to the contract shall be available for review and audit by the <br /> Auditor General or other STATE auditors and the City agrees to cooperate fully with any audit conducted <br /> by the Auditor General or other STATE auditors and to provide full access to all relevant materials. Failure <br /> to maintain the books, records and supporting documents required by this section shall establish a <br /> presumption in favor of the STATE for the recovery of any funds paid by the STATE under the contract for <br /> which adequate books, records and supporting documentation are not available to support their purported <br /> disbursement. <br /> 3. The jurisdiction and maintenance of any projects, in which these funds are expended on, will <br /> remain the responsibility of the CITY. <br /> 4. To accept jurisdiction and maintenance 21 days after execution of the AGREEMENT of the <br /> following section of highway in its present condition: <br /> • North and South Bound US 51 Business (FAP 710) from Cleveland Avenue northerly to Eldorado <br /> Street (US 36), in its entirety, as described in Exhibit A (BLR 05210 form), attached hereto and <br /> made a part hereof. This transfer does include structure number 058-0013. <br /> 5. North and South Bound US 51 Business (FAP 710) from Cleveland Avenue to Eldorado Street (US <br /> 36), in its entirety, shall remain a Truck Route unless the CITY gets approval from the STATE of an <br /> alternative route. To ensure that a free flow of truck traffic is provided the State will need to approve all <br /> geometrics and capacities along the proposed alternate t�uck route. Any State monies expended to update <br /> the alternative route shall follow Motor Fuel Tax standards, policies and procedures, including but not <br /> limited to, the apprenticeship and training program requirements of responsible bidders. <br />
