If to DEVELOPER: <br /> Tony Romano <br /> Romano Company <br /> 202 South Franklin Street <br /> Decatur, IL 62523 <br /> Any such notice or demand shall be deemed to have been given or <br /> made at the time it is deposited in the U.S. Mail. Developer or the City may from time to <br /> time designate any other address for this purpose by written notice to the other party. <br /> 13. Right to Substitute Spaces. During the term of this Lease, the City shall <br /> have the right to substitute other parking spaces, it may own or control, in <br /> lieu of the original parking spaces provided in this lease, provided that all <br /> other terms and conditions of this Lease shall remain applicable to any <br /> such substituted parking spaces. However, in exercising its right of <br /> substitution the City shall first give Developer at least thirty (30) days <br /> notice of the change, and the substituted spaces shall be of the like-kind <br /> and quality as the spaces presently leased, and shall be within the <br /> proximity of the Millikin Building located at 100 South Water Street. <br /> 14. Waiver. Failure or delay on the part of Developer or the City to exercise <br /> any right, power of privilege hereunder shall not operate as a waiver <br /> hereof. <br /> 15. Prior Negotiations. This contract constitutes the entire agreement of the <br /> parties hereto and shall supersede all prior offers, negotiations and <br /> agreements. <br /> 16. Assi�nment. Developer may assign its rights under this Lease to affiliates <br /> of Developer and subsequent owners of the Millikin Building 100 South <br /> Water Street ("Permitted Assi�ees"). It is expressly understood that in <br /> no event shall the parking spaces leased hereby be assigned to or <br /> controlled by any person, firm or corporation that does not hold a valid <br /> lease for all or a portion of the Millikin Building located at 100 South <br /> Water Street, Decatur, Illinois, and any such assignment shall cause this <br /> Lease to be null and void. <br /> 17.
