18. Severability. If any section, terms or provisions of this Lease or the <br /> application thereof shall be held to be invalid or unenforceable, the <br /> remainder of each section, subsection, term or provision of this Lease or <br /> the application of the Lease to the parties, shall not be affected thereby. <br /> 19. Termination. Notwithstanding the above, if either party hereto fails to <br /> comply with the provisions of this Lease, this Lease may be terminated if <br /> such failure is not corrected within sixty (60) days after delivery of a <br /> written notice to the other party specifying the non-compliance. <br /> 20. Eminent Domain. If the Premises or any portion thereof or any estate <br /> therein, or any part of the improvements located on the Premises <br /> materially affecting Developer's use of the Premises, shall be taken by <br /> eminent domain, this Lease shall terminate on the date when title vests <br /> pursuant to such taking. The rent, and any additional rent, shall be <br /> apportioned as of the termination date, and any rent paid for any period <br /> beyond that date shall be repaid to Developer. <br /> 21. Destruction of Premises. A total destruction of the improvements <br /> located on the Premises shall terminate this Lease and all rent and other <br /> sums payable by Developer hereunder shall be accounted for as of the date <br /> of such total destruction. <br /> 22. Disturbance of Use. In the event that access or quiet enjoyment to the <br /> Premises is compromised for ten (10) sequential days or for a total of <br /> twenty (20) non-sequential days during any twelve (12) month period such <br /> that Developer cannot reasonably use the Premise, then Developer may <br /> elect to terminate this Lease. <br /> [Signatures Appear on Following Page] <br /> AT1 32371889.8!37574-000001 <br /> 6 <br />
