No. 15-38 Petition of CHRIS JOHNS to rezone property <br /> located at 2525, 2535, 2545 and 2553 NORTH <br /> MAIN STREET from B-1 Neighborhood Shopping <br /> District to B-2 Commercial District. <br /> Ms. Suzy Stickle was sworn in by Mrs. Janet Poland. <br /> Ms. Stickle presented the recommendation of staff: <br /> The subject site is approximately 41,000 square feet and is located in the 2500 Block of North <br /> Main Street. The site is currently zoned B-1 Neighborhood Shopping District and is developed <br /> with a strip center and a parking lot. <br /> The petitioner proposes to rezone from B-1 Neighborhood Shopping District to B-2 Commercial <br /> District to allow for all those uses permitted in the B-2 Commercial District. <br /> The surrounding zoning includes B-2 Commercial District to the north, B-1 Neighborhood <br /> Shopping District to the south and R-3 Single Family Residence District to the east and west. <br /> There is also B-2 Commercial to the southeast of the site. The Macon County and Decatur <br /> Comprehensive Plan shows this area as Heavy Commercial. The permitted land uses in the B-2 <br /> District are compatible with the land uses and adjacent zoning districts to the north and south <br /> along North Main Street. <br /> The Comprehensive Plan shows this area along North Main Street as Heavy Commercial and the <br /> uses permitted in the B-2 Commercial District are compatible with uses that would be found in <br /> an area designated as Heavy Commercial. Commercial uses in this area of North Main Street <br /> would be appropriate for this site. <br /> Staff recommends approval of the rezoning. <br /> Section XXIX. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a <br /> public hearing on a rezoning request, and then forward its report and recommendation to the City <br /> Council for final approval. A motion to forward Calendar Number 15-38 to the City Council <br /> with a recommendation for approval is suggested. <br /> Mr. Kent Newton stated he knows the rezoning for this site is for a gaming parlor and asked if <br /> there is a limit to the number of video gaming machines within the City. Ms. Stickle said the <br /> State has not regulated the number of machines except for the number of machines per <br /> establishment. Mr. Newton asked if that limit was five (5). Ms. Stickle said yes. <br /> Mr. Chris Johns, petitioner, was sworn in by Mrs. Poland. <br /> Mr. Johns stated he would be happy to answer any questions. <br /> There were no questions and no objectors present. <br /> It was moved and seconded (Myatt/Smith) to forward Calendar No. 15-38 to the City Council <br /> with a recommendation for approval. Motion carried unanimously. <br />
