agrees to be responsible for any and all taxes or other payments due on payments received from the <br /> City hereunder and filing all necessary and appropriate disclosure statements with applicable <br /> governmental bodies. <br /> P. The CONSULTANT hereby recognizes, acknowledges and agrees that the CLIENT is a <br /> public body subject to the requirements of the Illinois Freedom of Information Act, 5 ILCS 140/1 <br /> et•seq. ("Act"). Any public records in the possession of CONSULTANT that directly relates to a <br /> governmental function of CLIENT and not otherwise exempt under the provisions of the Act <br /> shall be provided to the CLIENT or a third party requestor as directed by the CLIENT. Failure <br /> by the CONSULTANT to comply shall be grounds for declaring the CONTRACTOR to be in <br /> default and the Agreement null and void.
