DEPARTMENT OF WATER MANAGEMENT
Memorandum No. 2009-23
November 17, 2009
TO: Honorable Mayor Michael T. McElroy and City Council
FROM: Ryan P. McCrady, City Manager
Keith D. Alexander, Director of Water Management
SUBJECT: Decatur Park District Intergovernmental Agreement
Decatur Ai ort Water Main Im rovements
 p
TI N•
SUMMARY RECOMMENDA O .
Council adopt the attached resolution authorizing an Intergovernmental Agreement with the
Decatur Park District.
BACKGROUND:
The Decatur Park District (DPD) is planning significant improvements to the Decatur Airport's
water system by upsizing their 4 inch diameter water mains to 8 inch diameter mains. The DPD
must obtain an Illinois Environmental Protection Agency Division of Public Water Supplies
construction permit prior to the start of construction. This permit requires the City to accept all
maintenance responsibility for the water main and appurtenances (valves, fire hydrants, etc.)
after construction has been completed. Traditionally the City has not accepted maintenance
responsibility for water main systems on property not owned by the City. The primary reason
for this policy is that the City has little control over what physical improvements or landscape
enhancements landowners might construct on their property in the future after the water main has
been constructed. The City does not desire to be liable for the possible removal and
reinstallation of these improvements when the water main and appurtenances have to be
maintained in the future.
Since the City does not want the responsibility to maintain the airport's water main system,
especially since a large portion of the water main will be under several inches of pavement, the
attached intergovernmental agreement was created. DPD concurs with the contents of the
agreement and will formally adopt it as soon as possible.
POTENTIAL OBJECTION:
None foreseen.
STAFF REFERENCE:
Keith Alexander, Director of Water Management, 217-424-2863 or kalexander@decaturil.gov
Wendy Morthland, Corporation Counsel, 217-424-2807 or wmorthland@decaturil.gov
BUDGET/TIME IMPLICATIONS:
This agreement is at no cost to the City. Since DPD has already opened bids for this project, it is
imperative that the agreement be expeditiously approved.
cc: Bill Clevenger and Joe Attwood, Decatur Park District
