t • r � r <br /> DISPOSAL AGREEMENT <br /> This Agreement made this 5th day of October, 2009 by and between R & R Services of <br /> Illinois, Inc., its successors, agents and assigns and the City of Decatur ("City"). <br /> WHEREAS, it is agreed and understood by the parties that Jeffery S. Rose <br /> operates a recycling/composting facility known as R & R Services of Illinois, Inc. <br /> WHEREAS, City collects and transports landscape waste suitable for <br /> recycling/composting. <br /> WHEREAS, the parties agree that among the purposes of this agreement <br /> is to facilitate accessibility of landscape waste for recycling/composting, and to <br /> reasonably minimize the costs of collecting, transporting, depositing and recycling <br /> and/or composting of landscape waste. <br /> WHEREAS, this agreement reasonably protects lawful business interests of each <br /> of the parties and the parties believe this agreement to be reasonable in time, place and <br /> terms and further ensures a benefit to the community by providing a reasonable outlet <br /> for landscape waste at a fair and reasonable price. <br /> For and in consideration of the provisions set forth herein, R & R Services of <br /> Illinois, Inc. and City agree as follows: <br /> 1. The term of this agreement shall be from the 5th day of October, 2009 until <br /> October 6, 2012. <br /> 2. During the term of this agreement, the City shall transport landscape waste <br /> collected within the County of Macon, Illinois, to R & R Services of Illinois, Inc. <br /> recycling/composting facility, except for materials it retains for its use or to make <br /> available to its citizens. <br /> 1 <br />
