3. City agrees to deposit said landscape waste at said recycling/composting facility <br /> pursuant to the rules of the facility. <br /> 4. City shall pay R & R Services of Illinois, Inc. for the deposit of said landscape waste <br /> at the general and peak rates shown on Exhibit A for contract year 2010. For contract <br /> year 2011, the City shall pay the general and peak rates shown on Exhibit A, increased <br /> by a multiplier equal to the percentage change in the 20 City Construction Cost Index <br /> for the period October, 2009 through October 2010. For contract year 2012, the City <br /> shall pay the general and peak rates shown on Exhibit A, as modified for contract year <br /> 2011, and increased by a multiplier equal to the percentage change in the 20 City <br /> Construction Cost Index for the period October, 2010 through October 2011. <br /> 5. City agrees to comply with any and all rules of the recycling/compost facility <br /> relating to operations upon and around the recycling/compost facility. <br /> 6. City agrees to pay R & R Services of Illinois, Inc. within 30 days of date of <br /> invoice. <br /> 7. City agrees to pay finance charges, late fees, court costs and reasonable <br /> attorney's fees relating to invoiced fees remaining unpaid for more than 30 days. <br /> 8. R & R Services of Illinois, Inc. agrees to accept for disposal all segregated <br /> landscape waste for which R & R Services of Illinois, Inc. is permitted to accept <br /> pursuant the laws, rules and regulations of the Illinois Environmental Protection Agency <br /> which are transported to R & R Services of Illinois, Inc. recycling/composting facility by <br /> City pursuant to the terms of this agreement. <br /> 9. R & R Services of Illinois, Inc. agrees to mail to City invoices for fees incurred by <br /> City pursuant to this agreement. <br /> 2 <br />
