, . . <br /> . � . <br /> AGREEMENT <br /> for <br /> VENDING MACHINE OPERATOR <br /> This Agreement is made between the City of Decatur, Illinois (hereinafter called"City"), and the <br /> Illinois Department of Human Services, Business Enterprise Program for the Blind (hereinafter <br />� called "Contractor"). The City and the Contractor in consideration of the mutual covenants <br /> contained herein, and for valuable considerations exchanged between the parties hereto,hereby <br /> agree as follows: <br /> L GENERAL TERMS <br /> The City hereby grants the exclusive rights to operate vending machines offering food and <br /> beverage items on the City's Decatur Public Transit System properties to the Contractor for the <br /> uration of this A eement. The Contractor hereb a ees to rovide vendin machines and to <br /> d �' Y �' P g <br /> maintain and stock those machines, as per the specific terms of this Agreement, for the duration <br /> of this Agreement. <br /> 2. AGREEMENT DURATION <br /> This Agreement shall be in full force and effect for a period of five (5) years, starting at 12:01 <br /> a.m. (CST) on June 1, 2009 and ending at 11:59 p.m. (CST) on May 31, 2014,unless otherwise <br /> lawfully terminated under the provisions of this Agreement. <br /> 3. SCOPE <br /> The Contractor shall serve the following functions: <br /> • provide and install vending machines in locations designated by the City; <br /> • keep the vending machines in proper working order; <br /> • stock the vending machines and keep them well supplied with food and beverage items; <br /> • control the products and brands sold by the vending machines; <br /> • control the prices of items sold by the vending machines; <br /> • arrange for reimbursements to patrons filing claims; <br /> • provide the City with monthly sales statements; and <br /> • other services which may from time to time be required to fulfill the intent of this Agreement. <br /> - 1 - <br />
