13. SEVERABILITY <br /> Any provision or part of this agreement held to be void or unenforceable under any regulation, <br /> law or judgment of a court of competent jurisdiction shall be deemed to be stricken, and all <br /> remaining provisions shall continue to be valid and binding upon the Contractor and the City. <br /> 14. FAILURE TO ENFORCE <br /> The failure to enforce at any time any of the provisions of this Agreement shall not be construed <br /> to be a waiver of such provisions or to affect the validity of this Agreement, or the right to <br /> enforce each and every provision hereof. <br /> 15. THE AGREEMENT AND APPENDIX A <br /> The language contained in Appendix A, "REQUIRED CLAUSES", is incorporated into this <br /> Agreement by reference. The City and the Contractor shall comply with the terms and <br /> provisions set forth in said Appendix A. Also, the Contractor shall insert in any subcontracts the <br /> clauses set forth in Appendix A - "REQUIRED CLAUSES", along with their related exhibits, <br /> plus a clause requiring the subcontractors to include these clauses in any lower tier subcontracts. <br /> The Contractor shall be responsible for compliance by any subcontractor or lower tier <br /> subcontractor with these required clauses. <br /> This document and said Appendix A constitute the entire Agreement between the City and the <br /> Contractor; no terms, provisions, promises, statements or representations not contained herein <br /> shall be binding upon either party. <br /> - 6 - <br />
