{ <br /> ARTICLE III <br /> DUTIES OF THE TRUSTEE <br /> The Trustee shall have only those duties specifically assumed by it in this <br /> Agreement. The Trustee shall supervise the general operations of the Fund, and <br /> shall conduct the business and activities of the Trust in accordance with this Trust <br /> Agreement and applicable law. F�ccept as otherwise provided herein, the Trustee <br /> shall hold, manage and protect the Fund and collect the income there from and <br /> contributions thereto. The Trustee shall be responsible only for the cash and <br /> property actually received by it hereunder. The Trustee from time to time shall <br /> make payments or distributions from the Fund to such persons, in such manner, <br /> and in such amounts as the Administrator, or its agents designated in writing from <br /> time to time, shall direct. The Trustee shall have no responsibility to administer or <br /> interpret the Plan, to compute any amount to be paid to it by the Employers, to <br /> bring any action or proceeding to enforce payment of any contrib�tions to the <br /> Fund, or to see that the Fund is adequate to meet liabilities under the Plan. <br /> The parties to the Agreement acknowledge and agree that all such assets <br /> are held in the Trust on behalf of and at the risk of Plan Participants and any losses <br /> shall be borne solely by the Plan Participants there under. Except as provided in <br /> Section 6.1 (b), the Trustee shall have no discretion whatsoever with respect to the <br /> management, disposition or investment of the assets held in this Trust. <br />' 9 <br />
