Excerpts from Plan Commission Minutes of Apri12,2009 <br /> Cal. No. 09-19 Petition of MARK ALLEN, to amend the B-3 <br /> Planned Shopping District located at 245 WEST <br /> FIRST DRIVE for a new retail/restaurant facility. <br /> Ms. Stephanie Ashe was sworn in by Mrs. Poland. <br /> Ms. Ashe presented the recommendation of staf£ <br /> The subject site, containing 1.14 acres, is currently zoned B-3 Planned Shopping Center District <br /> and has been zoned as such since the 1960s. In 1998, it was amended to include more property <br /> to the north. In 2008, the previous building (Arby's fast food chain) was demolished and the lot <br /> has been vacant ever since. <br /> The subject petition requests that the B-3 be amended to allow for a two-user structure; a <br /> commercial/retail use and a restaurant/drive-thru use. The commercial/retail use would have a <br /> drive-thru with stacking spaces for four (4) cars. The restaurant/drive-thru use will have a drive- <br /> thru with stacking spaces for ten (10) cars. The amendment will update the existing strip <br /> development along West First Drive with a new building in addition to filling an otherwise <br /> vacant lot. <br /> The proposed amendment to the B-3 is consistent with the character of the surrounding <br /> neighborhood and general area and is consistent with the intent of the original B-3 and the <br /> Comprehensive Plan. <br /> Staff recommends approval of the amendment to the B-3. <br /> According to section XXIX.G. of the Zoning Ordinance the Plan Commission shall review the <br /> application at a public hearing and will make findings concerning the consistency of the <br /> application with the Comprehensive Plan, the Zoning Ordinance and other land development <br /> regulations. Based on the findings, the Plan Commission will make a recommendation to the <br /> City Council. A motion to forward Calendar Number 09-19 to the City Council with a <br /> recommendation for approval is suggested. <br /> Mr. Cochran, representative, stated Mr. Mark Allen, owner of the site, elected to tear down the <br /> Arby's building when Arby's decided not to renew their lease. Mr. Allen is proposing to build a <br /> 6,000 square foot building with probably two (2) tenants. This is the first step to renovation of <br /> Mr. Allen's property in the South Shores area. <br /> Mr. Matthew Jackson entered the meeting at 3:10 p.m. <br /> There were no questions and no objectors present. <br /> It was moved and seconded (Peck/Sadorus) to forward Cal. No. 09-19 to the City Council with <br /> recommendation for approval as presented by staff. Motion carried unanimously. <br />
