1 � <br /> � <br /> ORDINANCE NO. 2009-17 <br /> ORDINANCE AUTHORIZING EXEMPTION TO THE ZONING ORDINANCE <br /> - FRONTAGE AND ACCESS TO PUBLIC STREETS— <br /> - WIND TUNNEL ADDITION - <br /> WHEREAS, a request has been received from IRG Decatur, LLC, requesting an <br /> exemption to the Zoning Ordinance pursuant to Section IV. A. 8. to allow a lot without frontage <br /> on a public street, said lot to be legally described as Lot Two (2) of Wind Tunnel Addition; and, <br /> WHEREAS, said Lot Two (2) will have common ingress/egress through an access <br /> easement as shown on the final plat, and utility easements through Lot One (1) of said Addition; <br /> and, <br /> WHEREAS, the Owner's Declaration for Wind Tunnel Addition shall include provisions <br /> to insure that Lot Two (2) of said Addition will have fire protection water and water service at all <br /> times. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That upon the condition set forth below the above described Lot Two (2) of <br /> Wind Tunnel Addition be, and the same is hereby, exempt from Section IV. A. 8. of the Zoning <br /> Ordinance in that said Lot Two (2) is not required to ha�e frontage on a public street. <br /> A. That IRG Decatur, LLC shall record with the Macon County Recorder <br /> and shall maintain an access easement as shown on the Final Plat for said <br /> Wind Tunnel Addition. <br /> PRESENTED, PASSED, APPROVED AND RECORDED this 20th day of April, 2009. <br /> . <br /> .�- <br /> ICHAEL T.
