Excerpts from Plan Commission Minutes of Apri12,2009 <br /> Cal. No. 09-18 Wind Tunnel Addition-Access Easement located in the <br /> 600 to 700 Blocks of West Southside Drive. <br /> Mrs. Joselyn Stewart was sworn in by Mrs. Janet Poland. <br /> Mrs. Stewart presented the recommendation of staff: <br /> The subject site is currently developed. <br /> The Final Minor Plat of Wind Tunnel Addition was reviewed by Engineering, Fire and Planning <br /> and is approved pending approval of the access easement. The owner proposes to subdivide the <br /> property into two (2) lots in which one (1) of the lots will not have frontage or direct access to a <br /> public street. According to the Zoning Ordinance each lot shall have frontage on, direct access to, a <br /> public street or way that is improved to City standards, unless the Council shall otherwise direct, by <br /> approval of a subdivision plat so showing submitted, heard and considered in the manner provided <br /> in the Subdivision Regulations for the City. <br /> The purpose of the two (2) lot subdivision is to allow the owner of the old Borg Warner/Zexel <br /> facility to sell off the building commonly known as the Wind Tunnel building. The company which <br /> has leased the building for sometime desires to own the building. The Wind Tunnel building is a <br /> standalone building however it does have common access and common parking with the other <br /> buildings on site. <br /> The petitioner proposes to subdivide the property into two (2) lots. The proposed Lot Two (2) will <br /> not have direct access to Southside Drive. This will allow the petitioner to continue the sharing of <br /> the access without creating a new curb cut to Southside Drive. <br /> This subdivision will create a new lot(Lot 2) which includes the Wind Tunnel building and parking. <br /> Common ingress/egress and utility easements are being platted to provide full access to the building <br /> site. <br /> The Owner's Declaration has provisions to insure that the Wind Tunnel building will always have <br /> fire protection water and water service at all times. <br /> Staff recommends approval of the petition. <br /> A motion to forward Calendar Number 09-18 to the City Council with a recommendation for <br /> approval is suggested. <br /> Mr. Phil Cochran, representative, was sworn in by Mrs. Poland. <br /> Mr. Cochran stated there are three (3) buildings on the site. There is an office building, the old <br /> Borg Warner building, and the Wind Tunnel building which is requesting approval for the access <br /> easement. The easement would remain in place if the other buildings would be sold in the future. <br /> Mr. John Mickler asked if the Wind Tunnel building was the newest of the three (3)buildings and if <br /> it was the one in the northwest corner of the site. Mr. Cochran stated it was the newest building and <br /> when you drive in it was straight ahead. <br /> There were no objectors present. <br /> It was moved and seconded (Peck/Anderson) to forward Cal. No. 09-18 to the City Council with <br /> recommendation for approval as presented by staff. Motion carried unanimously. <br />
