Anderson Plaza <br /> Decatur, Illinois 62523 <br /> Attention: Matt Newell, City Engineer <br /> Re: Ordinance Prohibiting Groundwater Use <br /> Fonner Johnson Oil Lahniers Site <br /> 1298 West Eldorado Street, Decatur, Illinois <br /> Leaking UST Incident No. 20040352 � <br /> American Enviromnental Project Number: J-237074 <br /> Dear Mr. Newell: <br /> On behalf of Johnson Oil Company (Johnson Oil), the former owner of the above-referenced <br /> property, and Tony Romano, the current owner of the property, Ainerican Envirorunental <br /> Corporation (American Envirorunental) is currently remediating an underground storage tank <br /> (UST) release at this property. However, in order to expediently obtain a No Further Remediation <br /> letter for this property, and subsequently return the currently-vacant property to beneficial <br /> corrunercial use, the parties above request that the City of Decatur enact a Groundwater Use <br /> Ordinance (GUO) to prohibit the potable use of groundwater within a certain area surrounding the <br /> above-referenced property. <br /> According to the Groundwater Ordinance Status Chart inaintained by the Illinois Environmental <br /> Protection Agency's ("IEPA's") Division of Public Water Supply, the City of Decatur has already <br /> enacted six GUOs for discrete areas across the City. The purpose of the existing GUOs, as defined <br /> by the City of Decatur, is "...to liinit potential threats to human health from groundwater <br /> contamination while facilitating the redevelopment and productive use of properties that are at or <br /> around the source of chemical constituents." <br /> The proposed area for a GUO for the above-referenced site is defined as the inaximum modeled <br /> extent of groundwater impacts related to the gasoline release, as detennined using risk-based <br /> calculations under the IEPA's Tiered Approach to Corrective Action Objectives (TACO). The <br /> inaxiinum inodeled extent of iinpacted groundwater exceeding default reinediation objectives is <br /> 994 feet. Therefore, the proposed extent of the requested GUO is 1,000 feet in all directions <br /> around the above-referenced site. The attached Figure 1 depicts the proposed extent for the <br /> GUO. Calculations to detennine the maximum modeled extent of groundwater impacts are <br /> docuinented in the attached March 13, 2009 Amended Corrective Action Plan. <br /> American Envirorunental completed a water well survey as part of Site Investigation for the UST <br /> release at the site. A Site Investigation Coinpletion Report (SICR) subinitted to the IEPA on <br /> September 3, 2008 included maps showing the locations of water wells listed in databases <br /> maintained by the Illinois State Geologic Survey, Illinois State Water Survey, and the Agency's <br /> Corporate Office Regional Office Regional Office Regional Office <br /> 8500 Georgetown Road 3700 W.
