� � i <br /> Excerpts from Plan Commission Minutes of February 5,2009: <br /> Cal.No. 09-06 Petition of JOHN SCOT MUELLER, to rezone <br /> property located in Mueller Heights Addition <br /> (addresses ranging from 225 East Mueller Court to <br /> 310 East Mueller Court and 1750 South Mueller <br /> Court to 1970 South Mueller Court) from R-3 <br /> Single Family Residence District to PD Planned <br /> District. <br /> Mrs. Joselyn Stewart was sworn in by Mrs. Janet Poland. <br /> Mrs. Stewart presented the recommendation of staff: <br /> The subject site is approximately 19.32 acres and is currently developed with infrastructure. <br /> This 19.32 acre-site is subdivided into 19 lots; 16 lots will be sold for residential development <br /> and three (3) lots are common areas for the development. The petitioner is proposing the <br /> construction of four (4) single-family units and twelve (12) two-family residential units totaling <br /> 28 residential units. The sole access to Muller Heights will be provided by East Mueller Court <br /> and South Mueller Court which terminates in to a cul-de-sac. <br /> The density of the proposed buildable area of the development is one (1) unit per 17,984 square <br /> feet. The density of the total development (which includes the three (3) common areas) is one <br /> (1) unit per 30,056 square feet. The minimum density requirement for R-3 development is one <br /> (1)unit per 6,000 square feet. ' <br /> Parking will be provided by two (2) car garages and private driveways that will be constructed in <br /> accordance with plans and specifications approved by the City. ' <br /> It has been determined by the Engineering and Infrastructure Department that a Traffic Impact �I <br /> Report will not be required. They have determined that this development will not be a high <br /> volume traffic generator. The roadway and intersections of South Shores Drive/South Franklin <br /> Street Road and East Mueller Court should maintain a comfortable and stable traffic flow. <br /> Landscaping meeting the required points far the frontage as well as buffer yards has been <br /> installed. <br /> City water and sewers are provided to the development. Each unit will have an individual <br /> connection to sewer and water. <br /> Staff believes that the proposed development is compatible with the surrounding area and will <br /> have a positive impact on the neighborhood. The plan is consistent with the comprehensive plan <br /> for low density residential development. The existing streets are adequate to carry the <br /> anticipated traffic of the development. The existing utilities are adequate to serve the <br /> development. <br /> The PD plan has been reviewed by the City's Technical Review Committee; Planning, <br /> Engineering and Fire have approved the proposed plan. <br /> Based on the analysis, staff recommends approval of the rezoning to PD Planned Development <br /> with the following conditions: <br />
