No. 08-53 Petition of SOY CAPIT L BANK to vacate an alleyway south of the �500 BLOCK of EAST ELDORADO STREET. Ms. Pinnamaraju was sworn in by Mrs. Kim Althoff. Ms. Pinnamaraju presented the recommendation of staff: The petitioner is requesting to vacate public right-of-way in the Alleyway between East Street and North 16�" Street south of 1501 East Eldorado. The vacation will enable the petitioner to install a fence to add much needed additional security. Swartz Management Corporation has been notified by the petitioner r�garding the vacation and has no objections. The petitioner owns all other adjacent properties. Letters were sent to AmerenIP, Comcast Communications, and A &T notifying the utility companies of the vacation request and no objections to the proposed ri ht-of-way vacation have been expressed. An easement will be reserved for utility access. Because there is only one (1) licensed cominercial appraiser in the Cit�r of Decatur, only one (l) appraisal was conducted on the property. The proposed vacated property has an estimated market value of$4,000 which will be paid to the City. The right-of-way is not necessary to serve the general public. Staff is of the opinion that the best interests of the City of Decatur would be served by approving the request to vacate the alley right-of-way. Staff recommends approval of the petition. The Administrative Policy of the City of Decatur requires that property vacation requests be submitted for a public hearing. Although a Plan Cominission recominendation is not required, a motion to forward the request of Cal. No. 08-53 to the City Council with a recoinmendation for approval is suggested. Mr. Phil Cochran was sworn in by Mrs. Althoff. Mr. Cochran stated that the bank was once a victim of a robbery; there re, additional security is desired. Mr. Cochran added that vacating the public right-of-way in the alleyway will enable the petitioner to install a security fence. Mr. Cochran stated that most of he parking stalls will be located within the security fence. It was inoved and seconded (Livingston/Jackson) to forward Cal. No. 08-53 to the City Council with recommendation for approval as presented by staf£ Motion carried unanimously.
