No. 08-53 Petition of SOY CAPIT L BANK to vacate an <br /> alleyway south of the �500 BLOCK of EAST <br /> ELDORADO STREET. <br /> Ms. Pinnamaraju was sworn in by Mrs. Kim Althoff. <br /> Ms. Pinnamaraju presented the recommendation of staff: <br /> The petitioner is requesting to vacate public right-of-way in the Alleyway between East Street <br /> and North 16�" Street south of 1501 East Eldorado. The vacation will enable the petitioner to <br /> install a fence to add much needed additional security. <br /> Swartz Management Corporation has been notified by the petitioner r�garding the vacation and <br /> has no objections. The petitioner owns all other adjacent properties. <br /> Letters were sent to AmerenIP, Comcast Communications, and A &T notifying the utility <br /> companies of the vacation request and no objections to the proposed ri ht-of-way vacation have <br /> been expressed. An easement will be reserved for utility access. <br /> Because there is only one (1) licensed cominercial appraiser in the Cit�r of Decatur, only one (l) <br /> appraisal was conducted on the property. The proposed vacated property has an estimated <br /> market value of$4,000 which will be paid to the City. <br /> The right-of-way is not necessary to serve the general public. Staff is of the opinion that the best <br /> interests of the City of Decatur would be served by approving the request to vacate the alley <br /> right-of-way. Staff recommends approval of the petition. <br /> The Administrative Policy of the City of Decatur requires that property vacation requests be <br /> submitted for a public hearing. Although a Plan Cominission recominendation is not required, a <br /> motion to forward the request of Cal. No. 08-53 to the City Council with a recoinmendation for <br /> approval is suggested. <br /> Mr. Phil Cochran was sworn in by Mrs. Althoff. <br /> Mr. Cochran stated that the bank was once a victim of a robbery; there re, additional security is <br /> desired. Mr. Cochran added that vacating the public right-of-way in the alleyway will enable the <br /> petitioner to install a security fence. Mr. Cochran stated that most of he parking stalls will be <br /> located within the security fence. <br /> It was inoved and seconded (Livingston/Jackson) to forward Cal. No. 08-53 to the City Council <br /> with recommendation for approval as presented by staf£ Motion carried unanimously. <br />
